Case Study : Medical negligence case was dismissed by Abu Dhabi Court on these grounds

A resident of Abu Dhabi has filed a lawsuit against the hospital for misdiagnosing him after he suffered a finger #injury after causing severe pain after exercise.

He demanded 100,000 Dh as compensation from the hospital for the physical, moral and material #damages suffered.

In his lawsuit, the Arab said he was injured playing sports in March of this year, after which he went to the hospital after feeling pain in his right shoulder and surrounding muscles. At the hospital, doctors #diagnosed him with pain, muscle pain and swelling in his right shoulder. The man received treatment and was on sick leave for 21 days.

However, he later found that the pain increased and his left index finger was so swollen that he was unable to do his job. A visit to another clinic revealed that he had actually broken his finger and needed urgent #medical attention.

The applicant noted that the misdiagnosis worsened his #health and mental state, exacerbated his pain, and necessitated emergency surgery.

He also stressed that the hospital's failure to diagnose his condition prevented him from working for weeks, which negatively affected his eligibility and benefits from his job. In its defense, the hospital requested dismissal of the lawsuit for failing to follow the procedures stipulated in Law No. (4) of 2016 on Medical Liability. The hospital's #attorney also claimed there was insufficient #evidence to identify his client.

After hearing all parties, the Abu Dhabi Family and Civil Administrative Court dismissed the case. In his ruling, the judge said a #claim for medical #malpractice compensation could only be asserted after filing an #appeal with the Medical Malpractice Board, which the #petitioner did not do.
