What is a Binding Ruling?
A binding ruling enables importers and other interested parties to get binding pre- or post-entry classification decisions for importing a product and filing entries with Customs and Border Protection (CBP).
Why are Binding Rulings important?
With the ever-changing nature of the HTSUS and its many interpretations, a binding ruling can be used as a means of protecting your company and the classifications it utilizes.?
Classification is at the core of how your goods are treated, what duties they will or will not pay, and whether they are applicable for trade agreements, and/or must be kept under the watchful eye of a participating government agency or other trade regulation body. It’s important to have the right classifications for your goods in order to ensure that your imports and exports are being handled properly as they make their way through your supply chain. Having a binding ruling in place for your goods helps instill confidence in your classifications.
How to request a Binding Ruling?
A ruling may be requested under 19 CFR 177 by any person who, as an importer or exporter of merchandise, or otherwise, has a direct and demonstrable interest in the question or questions presented in the ruling request, or by the authorized agent of such person (AKA us, your broker).
There are other types of rulings such as valuation and carrier available.
Requests for tariff classification rulings should be addressed to the Director, National Commodity Specialist Division, U.S. Custo,s. Attn: Classification Ruling Requests, New York, New York 10048, or to any service port office of the Customs Service. Requests can also be made electronically at https://erulings.cbp.gov/s/.
