A bad experience once working in a trading company:

Between October 2016 and September 2017, I worked in a clothing trading company. It was my first job after graduating from college. When I first joined the company, I was happy, thinking that I could work hard in this company and get corresponding rewards. However, the final result was indeed unhappy and I felt extremely regretful.


This trading company was only established in 2016, so in the first three months of joining the company, we spent a lot of time doing related work, such as helping to build the company's website, helping to improve the company's profile, and learning How to use PS and spend a lot of time on how to find customer information, etc. So we officially started business development work around March 2017, and received responses from some customers one after another. In September 2017, I chose to resign due to the work atmosphere and pressure. Six years after leaving my job, I really learned a lesson.


1. Labor contract trap: Chinese law stipulates that the company should sign a labor contract with employees from the month they join the company to ensure their legitimate rights. However, the company signed the contract with its employees in February or March 2017, and the contract signing date was written in October 2016, and the contract stipulated some confidentiality and non-competition clauses. However, a legitimate contract, non-competition and confidentiality agreement should also stipulate the rights and obligations of both parties. ?If some company's technical secrets are really involved, after the employee leaves, the company should pay the employee corresponding fees to make the contract effective. However, the company set a very strict confidentiality clause in the employment contract, but the company did not take any measures or pay any fees for this. Rights and obligations are inconsistent.


2. Concerning the illegality of employee social security. According to my social security payment record and the time certificate on the labor contract, from October 2016 to March 2017 after I joined the company, for a period of 5 months, the company failed to purchase social insurance for its employees in accordance with the law. This means that during this period, if an employee has any accident or injury during work, we will have to pay the full medical expenses ourselves without receiving any government or insurance subsidies.


3. The payment of wages is illegal. Employee wages should be paid from the company's formal account, and personal income tax must be reported to the government based on the actual company. But our salary is paid by the company's employees using private bank cards. Some employees' commissions are even paid directly in cash. This means that the company has committed tax violations and will have a negative impact on our personal tax credit.


4. There is no overtime pay for overtime work.


5. From the time I join the job to the time I leave, my salary is the basic salary without any bonuses or commissions. Because the production cycle of clothing is long, I have not followed up on any bulk production from any customer during my employment. I have only 0 experience related to bulk production, delivery, transportation, customs declaration and export, etc. However, I was tacitly understood about the entire trade sales process because the boss was misleading others.


From an emotional perspective: When I joined the company, I had a colleague with relevant work experience. She joined the company at almost the same time as me, and she selflessly shared a lot of professional knowledge with me. However, when she resigned, the boss insulted and slandered her in the meeting, including but not limited to saying that she was a giant baby, naive, etc., which made me very disappointed because she taught me a lot but was maliciously slandered. What confuses me is that as a boss you can coach or fire your employees, but is it right to insult your employees? Moreover, the night before I left my job, this boss called a meeting with all my colleagues and also humiliated me personally at the meeting. This may be their company's tradition.


I weighed 45KG when I joined the company and weighed 39KG when I left the company. After leaving my job, I did not join the company or work in the same industry. From December 2017 to February 2019, I worked for a Plastic injection mold and molding company. I am very grateful to this company, because during the first year and a half of joining the company, I personally participated in the entire process from sample production to batch shipment, making my foreign trade experience complete. In March 2019, I found a clothing factory and confirmed with the factory boss that I would serve as their sales representative to expand overseas business for them. However, the most outrageous thing happened. Five years after I left my first job, the boss of the first company I worked for told our client that she had spent a lot of time teaching me how to work, and said a lot of negative things about me and my company.


Looking back on the above experience, I wonder if the boss at my first job was delusional? Moreover, few employees who leave their company continue to work in related industries, why is this? is it really normal?


I hope everyone will keep their eyes peeled and stay away from such irregular companies as soon as possible. At the same time, if you find that your legitimate rights and interests have been violated, then you can:

1. Collect your salary stubs, labor sums, social security records, and commission vouchers, and submit these materials to the tax bureau, arbitration bureau, and labor bureau. All your due rights will be paid in time.

2. Regarding maternity leave, marriage leave, bereavement leave, etc., the law stipulates that paid leave can be taken. If a company goes out of its way to deduct your pay or make you take these days off for other reasons, it is illegal. You can apply for legal aid from the Labor Bureau.

3. Regarding the payment of wages, they must be paid through proper channels and declared according to the real wages. Otherwise, the company can leave you with tax risks after you leave your job.

4.The labor contract should also stipulate the payment standard and payment time of commission. Company managers should not change the rules at will and decide whether to pay employees the commissions they deserve after resigning based on their mood.


As a worker, while working hard, you must safeguard your legitimate rights and interests.
