Can a Person With Disability Apply For a Canadian PR?
Canada allows even a disabled person to apply for the permanent residency program. Considering the restrictions disability can put on these applicants, the Immigration, Refugees, and Citizenship Canada (IRCC) accommodates the mentally or physically disabled people as they may not be able to create Express Entry profile for PR.
The steps initiated for disabled persons interested in filing for Canadian PR have been designed in such a way that fraud is prevented and the overall process is handled equitably and fairly.
Canadian Ministry Exempts Person With Disability From Submitting Canadian PR Application Electronically
The Express Entry Ministerial Instructions allows immigrants to submit their application for PR under Express Entry electronically. However, the Ministerial instructions also exempt disabled people from this mandatory requirement in the case the immigrants are disabled and are unable to complete their Express Entry profile online.
The rule also exempts disabled people from submitting APR electronically under the Express Entry program. Such foreign nationals with either mental or physical disability can approach IRCC Call Center and relate their difficulty in completing an electronic APR or Express Entry profile. Some of the disabilities that may receive consideration from IRCC include low vision, cognition, blindness, and mobility and dexterity.
IRCC will also take into consideration whether the applicant has a family member or a friend or access to an authorized representative or community resources that can help him fulfill the application formalities for the Express Entry Profile.
Canada Introduces New Threshold For Admissibility of Disabled Immigrants
Very recently the Federal government of Canada declared permanent adoption of changes in the threshold of medical inadmissibility as the demand for the same has escalated in the last few years. This is a good opportunity for disabled applicants who were earlier barred from getting permanent residency based on their medical history.
According to IRCC, this change will open doors for the majority of the applicants who have been denied entry into Canada earlier due to medical reasons. Earlier the Immigration Ministry said in 2018, “The current provisions on medical inadmissibility are over 40 years old and are not in line with Canadian values or our government’s vision of inclusion.”
