Calling Legacy Managers: Charity Act 2022 - rule changes from 7 March

A quick note that will be relevant to Legacy Managers, Institute Of Legacy Management members and Make A Will Online Legacy Loop attendees.

Some more incremental but important parts of the Charity Act came into force on 7 March. Two key changes are to:

Charity Land (ss18-23)

The is relaxed restrictions on disposing of land owned by charities allowing some additional flexibility when completing the formalities of selling assets.

Consult your specialist conveyancer or surveyor for further details.

Charity Mergers (ss33-35)

Will this be the end of the "Cy Pres" arguments? Well - hopefully in part!

This is most applicable where a will contains a provision preventing a charity receiving a gift if the charity has ceased to exist.

These restrictions in wills should not apply where the charity has merged. A major bonus will be to reduce the need to keep shell organisations alive to benefit from gifts that may or may not still be out there.
