This week, the concept of One India and a unified market for labour in India received a major jolt.
The Andhra Pradesh assembly on Wednesday passed the A.P. Employment of Local Candidates in Industries/Factories Bill. The same imposes 75% quota for locals in private industrial jobs.
The ícing on the cake is that it becomes incumbent on part of the employer to train the local people with the requisite skills. You can’t take a plea that adequately skilled people are not available
This undermines Article 19 of the Constitution which guarantees freedom of movement to Indian citizens, as also Article 14 (Right to Equality) and Article 16 (Right to Equal Opportunity).
It is one thing to enact a law and another to implement it. Even in this case, exempted industries are fertilisers, coal, pharmaceuticals, petroleum and cement for now; and it is likely that the stipulation does not extend to the IT industry.
Political ploy, however, give scheming parties, rich dividends in the short term.
Hence, the larger question is what if other states start following suit – there are already similar demands in Madhya Pradesh and Tamil Nadu.
And most importantly, if the private sector comes in the purview of reservations, it sets the cat amongst the pigeons. It interferes with the entrepreneur’s right to choose the deserving one for running the business that’s financed by his/her sweat& blood.
It’s an idea that must be given a quiet burial.
