Business uncertainty over the revision of REACH

From 1 May 2025, new hazard classes, including endocrine disruption, apply to some products, although it is unclear how classification and labelling by the supply chain should be implemented.

ECHA is expected to update its CLP guidelines for new hazard classes by the end of this month; however, industry associations have insinuated that this may not give companies enough time to conduct the? necessary assessments to meet the May 1 deadline, which applies to new-to-market products.

The CLP Regulation is being revised in two parts that include a wide range of changes to the legislation regarding MOCS, the obligation to notify ECHA of classifications, CLH from ECHA or the European Food Safety Authority (EFSA), harmonised classifications for groups of substances, labelling (including formats, digital labels, folded labels), advertising and poison centre notifications.

Updates to ECHA's guidance are expected next year to take account of the ordinary legislative process, with the agency starting the task of publishing the final legislation.

For new hazard classes, they should take steps to ensure that relevant data is up to date and start talking to raw material suppliers about the "huge improvement in communication" that will be needed.
