PFAS RELATED CORPORATE NEWS FROM SEC FILINGS AND EARNINGS CALLS DURING THE LAST WEEK
Clarus Corp reports that sales in their outdoor segment and more specifically their adventure segment were down roughly 12% from the same quarter last year. Still, gross margin rates in the third quarter increased by about 5%. This increase was partially offset by an increase in PFAS related inventory reserve expenses. The company also reported a loss from continuing operations which included $0.4 million of charges related to legals cost and regulatory matters and $1.9 million related to PFAS inventory reserve costs.
?Artesian Resources Corp. reports that several of its' subsidiaries are claimants in the PFAS MDL class action litigation involving 3M, DuPont, Chemours and Corteva. The proposed settlement of these legal actions may lead to a recovery of some funds by the subsidiaries by the amounts are uncertain at this point. The subsidiaries are also claimants in the MDL class action against Tyco Fire Products and Chemguard. Settlement terms have been reached in this legal action but is not yet effective; recovery amounts, if any, are uncertain at this point. The company also reports: "The Company has installed treatment for?PFAS?at several wellfields to date and has included installation of treatment at additional locations in 2024 in its capital budget, with any remaining necessary treatment planned to be installed before 2029.? The capital investment and operating costs for treatment of?PFAS?are anticipated to be recoverable in water rates charged to customers as approved by the applicable public service commission." It sounds like a good possibility that customers will wind up paying higher water rates.
Arq Inc. reports that the company experienced a decrease in demand for their products from coal-fired dispatch and electricity power generation customers compared to the same time last year. Factors included lower natural gas prices resulting in several large utility customers opting to use natural gas instead of coal as their primary source for power generation. Natural gas prices are expected to remain pretty constant in 2024 but abundant natural gas reserves. The company does expect that the EPA's NPDWR regulations and focus on PFAS will spur a health increase in demand for their contaminant removal technology in the water purification market.
