BUILDING BLOCKS
If LEGOs, Erector Sets and Lincoln Logs in childhood inspired Architects, Engineers and Constructors in adulthood – What Builds Construction Lawyers?
To begin, the building blocks that shape a talented lawyer include: ?persuasive, intelligent, confident, insightful, creative, organized, effective, efficient, patient and compassionate.? A talented construction lawyer then enjoys an innate understanding of the built industry and all the nuances found in vertical and horizontal construction, along with managing client expectations be it in the private or public sectors.? As children, I suspect, they were highly analytical and engaged; as teenagers curious, guided by truth and discovery; as adults determined, results driven and perhaps competitive.? All abilities and capabilities required to build a compelling argument and thereby achieve a successful outcome.
The architects, engineers and constructors here at NCF Experts are privileged to be the blocks in-house and outside counsel rely on.? As our clients build commercial, industrial, institutional and infrastructure projects it is our duty to bring the best tools and representation available – a solid foundation meriting a smooth process and optimal resolution.
We look forward to seeing you in Pittsburgh at the American Bar Association Forum on Construction Law 2024 Fall Meeting:? The Built Environment:? Drawing on Design.
UP ON THE ROOF
Losses involving commercial and residential structures occur daily throughout the world. Some are attributed to catastrophic weather events; some are attributed to human error originating from improper methods and means of construction, failures of building systems (electrical, mechanical, building envelope, plumbing); and some are attributed to fires and explosions.
Most roof claims come after a wind and rain event when the property manager or owner observes water stains or buckling. These “roof leaks” however may not be caused by wind or hail damage, but could be a leaking air conditioning condensate drip pan, faulty roof installation, decay, pre-existing damage, etc. It is important to gather thorough observations and back up findings with maintenance and weather history.
The basic building blocks of a roof inspection include:
When doing forensic inspections, it is important to keep an open mind, gather as much information as possible, confirm your conclusions, and check carefully when things are not reasonable or consistent.
Back to the basic building blocks, we all know the lawyer and consultants’ role is to help our clients by determining the best way to investigate a loss or failure, to craft an approach, and help manage or mitigate their claim or matter.
