Breaking News: XTL Transport introduces Hourly Pay for all its Cross-Border Fleet!

Effective July 22, 2018, XTL Transport will be compensating its US cross-border Drivers Hourly.

All US drivers will be paid for all the Hours of Service they work. There will be an hourly On Duty Driving Rate and On Duty Not Driving Rate. Over time will also be paid for any On Duty Hours over 60.

In addition, the Hourly On Duty Driving rate will be scaled up based on the years of verifiable experience of each driver.

With these New Increases, XTL finds itself among a select few Canadian Carriers to pay the Drivers for all the movements made in their work.

Just curious Luc, does this mean drivers will qualify for overtime pay after a predetermined period that provincial hourly drivers are entitled to currently, was this considered or just manage driver's routes where possible to reflect that aspect? I know these types of costs effect the transport industry greatly. Thanks.

That's great news for the industry Luc. Our company is also preparing to launch a similar program for our drivers. I'm curious, are you using ELD data to track driving and non-driving work hours? Did you need to have any software customized for this project? Our plan is to use ELD data but we're still working on the best way to extract the data as the provider does not have reporting designed for payroll purposes. Also, did you guys do anything do address the potential issue that this system can encourage certain drivers to take longer in performing certain activities such as pre-trips, loading/unloading, fueling, etc.???

I advocate for being paid for all time at a flat rate. here in the States. So lets do the math. If I understand it correctly, Employee OTR Drivers work a 24hr duty cycle. 785.22 & 785.41 work together to exempt these Drivers from 8hrs pay per day leaving 16 compensable hours per day. Bona Fide Meal breaks are questionable. 16 X 7 = 112 compensable hours. OT after 8 daily would be 56hrs flat and 56hrs OT. 56 X $7.25 = $406.00 56 X $10.875 = $609.00 Total of $1,015.00 Lets do it another way. 40hrs X $7.25 = $290.00 72hrs X $10.875 =783.00 Total of $1,073.00 My way. 24hrs X $7.25hr X 7 days = $1,218.00 $1,218.00 pays for 168 On The Job Hours. If we use the 60hrs in 7 day rule, $1,218.00 buys 60 log book hours. $1,218.00 / 60hrs = $20.30 per log book hour. Lets say that a Driver logs 75hrs of "Driving" and "On Duty Not Driving" in the 7 day payroll period. The carrier bought 60 log book hours for $1,218.00. The carrier required 15 additional log book hours valued at $304.50. The Driver earned $1,520.00. 168 hrs spent on the job = 60 log book hours This is a ratio of 168 to 60 that equals the ratio of 2.8 to 1. Using this ratio we can easily calculate partial weeks and even days. Driver spends 133.5 hours on the job. 133.5 / 2.8 = 47.6785714 log book hours. 133.5 X $7.25hr = $967.875 47.6785714 log book hours X $20.30 = $967.875 Lets say the Driver logged 52hrs within 133.5hrs spent on the job. 52 X $20.30 = $1,055.60 The ELD knows when a tour of duty starts and ends. The ELD knows how many log book hours have been logged. This method works flawlessly with the HOS. This method would require that 785.41 be modified. § 785.41 Work performed while traveling. Any work which an employee is required to perform while traveling must, of course, be counted as hours worked. An employee who drives a truck, bus, automobile, boat or airplane, or an employee who is required to ride therein as an assistant or helper, is working while riding, except during bona fide meal periods or when he is permitted to sleep in adequate facilities furnished by the employer.
