Breaking News | IRCC to Implement Stricter Rules on Family Open Work Permits in 2025

Starting January 21, 2025, the Immigration, Refugees, and Citizenship Canada (IRCC) will enforce tighter restrictions on family open work permits (OWP) for the spouses and common-law partners of international students and foreign workers. Here's what you need to know about these important changes.

New Rules for Family Open Work Permits

  1. For International Students The spouse or partner of an international student will only qualify for an open work permit if the student is:
  2. For Foreign Workers The spouse of a foreign worker will now only be eligible for an open work permit if the worker is:
  3. Exemptions

Impact on Existing Open Work Permits

For those who have already been approved for open work permits, these permits will remain valid until their expiration date. Eligible family members in Canada can still apply for extensions under the same terms, provided they meet the criteria matching the principal applicant’s permit duration.

Why Are These Changes Happening?

These adjustments are part of Canada’s broader immigration reforms aimed at reducing the number of temporary residents to address issues like housing shortages and affordability concerns.

Announced initially in September 2024 by Immigration Minister Marc Miller, the changes are expected to reduce the number of family open work permits issued by 50,000 for international students and 100,000 for foreign workers over the next three years.

Benefits of Open Work Permits

Open work permits are highly sought after by newcomers because:

  • They allow holders to work in most industries across Canada.
  • They are not tied to a specific employer, unlike closed work permits that often require a Labor Market Impact Assessment (LMIA).

Alternatives for Families

If your family member no longer qualifies for an open work permit under these new rules, consider applying for closed work permits, which can sometimes be LMIA-exempt.
