As we observe Special Needs Planning Month, it’s essential to stay informed about key policy changes that impact individuals who are differently abled.
If you or a loved one receive Supplemental Security Income (SSI), recent updates to the In-Kind Support and Maintenance (ISM) rules could affect your benefits. Previously, ISM included outside help with food and shelter, meaning living rent-free or receiving meals from someone could reduce your SSI benefits. However, starting September 30, 2024, food will no longer be considered ISM. This change means that only assistance with shelter will lead to a reduction in benefits.
For those managing supplemental needs trusts, this adjustment is significant. Trustees will now have the freedom to pay for a beneficiary’s groceries or meals without worrying about incorrect reporting or a decrease in benefits.
