BOX JUNCTIONS
I always advise my clients to view the video for Box Junction PCNs before deciding to challenge or pay and what they are looking for is this.
1. The video recording must show your car just before it enters the box.
2. At the time of entry you must also be able to see the exit side of the box, and be able to determine whether the exit is clear.
3. There must be no doubt that your car has stopped in the box, and generally less than 10 seconds does not count. (De minimis non curat lex)
4. If the camera moves around while you are stopped the evidence is questionable (If the camera is moving, how can it be certain your vehicle is not moving).
5. The number plate must be readable at some point in the recording.
6. The video must be good quality, in colour and run smoothly.
7. Lighting and weather must be favourable.
Quite simply, the most important point is, when you started to enter the box, was the other side clear enough for you to make it without stopping in the box?
If so, then even if another vehicle or pedestrian causes you to stop in the box, you cannot be held liable. If the vehicle is moving slowly, it hasn't 'stopped' in the box.
Now, some councils allow the video to be viewed online or you can call to arrange to see the video.
If you can, please view the video by keying in the PCN no. & Vehicle Reg at the link that should be provided on the PCN or just go straight to their website to view.
Still images only tell their story and remember if you are onsite viewing, you do not need to say or sign anything; just make your notes and let them know if you intend to appeal or pay.
No Video? No offence occurred and the PCN must be cancelled as the offence is known as a ‘Moving’ Contravention, so there MUST be video evidence of this. Still images do not apply for ‘Moving’ Contraventions for the reason given in my previous paragraph.
