David McKELVEY
‘The Only Thing Necessary for the Triumph of Evil is that Good Men Do Nothing’ The Founder and CEO at My Local Bobby Ltd and the UK’s leading Private Prosecutor and Investigations Company TM Eye Ltd.
Amadu Ware BAH of Annesley Road, Edgware, London, NW8, appeared at Camberwell Magistrates Court on 24th February 2020. He was charged with four offences of selling counterfeit goods and possessing counterfeit goods for sale contrary to Section 92 of The Trademarks Act 1994. He pleaded guilty to all offences. He was fined £657 and ordered to pay a Victim Surcharge of £65.
The case was brought by TM Eye as a private criminal prosecution on behalf of Mulberry and another well-known luxury goods brand.
BAH ran a substantial stall at Bovingdon market in Hertfordshire selling a large range of fake luxury goods from brands including Michael Kors, Chanel, Gucci, Superdry and many others. No enforcement action was taken in relation to these brands.
Between 21st May 2019 and 8th June 2019, Amadu BAH was evidenced by TM Eye undercover operatives selling counterfeit goods on three separate occasions. Three test purchases were covertly recorded.
TM Eye Director David McKelvey said, "TM Eye continue to prosecute criminals who openly sell fake goods that impact our clients at Bovingdon Market. Over 100 criminals have been convicted at this market alone by TM Eye, through private criminal prosecutions. Brands that TM Eye protects are rarely seen or sold in the market now but where they are identified we will immediately gather evidence and where necessary prosecute.
These criminals cause significant economic harm to the companies involved who have spent years and huge sums in building reputable brands. They pay no tax. The source countries from where these goods originate are involved in large scale human slavery, often with children involved in the illicit production in horrendous conditions. The trade in fake goods has been evidenced to fund terrorism and organised crime.
TM Eye have convicted over 500 criminals by way of private criminal prosecutions and have a 100% conviction rate. 13% of those TM Eye convicts receive custodial sentences. Every conviction is recorded on the Police National Computer and those convicted have their fingerprints, photographs and DNA taken."
