Big Criminal Corruption of Jamaican Judge, Alicia McIntosh blatant sell out of court case to ICWI highly corrupt lawyer, Miguel Palmer.

Criminal Corrupt Judge, Alicia McIntosh is the Senior Magistrate at the Sutton Street Court in Jamaica. On July 24, 2023, in my civil action claim suit for Negligence against Insurance Company of the West Indies (ICWI), highly corrupt judge Alicia McIntosh gave corrupt favor to ICWI highly corrupt Lawyer, Miguel Palmer, who presented an unlawful fraudulent oral defence to the court. Alicia McIntosh corruption has been reported to the Chief Justice of Jamaica.

The grossly unprofessional ICWI that now exist was sued for Negligence by Omission that resulted in damages to me. On Thursday December 31, 2020, ICWI choose to close office at 12 noon instead of the normal 4pm closing time on the normal working day, and again fully closed on the normal opening of 10:00am to 2pm on Saturday January 2, 2021, with no regards for its customers. Certainly there was no Covid restriction in place for businesses to close early. I went to the office at 1:30pm on Thursday December 31, 2020, to pay my 3rd quarter renewal payment for my one year car insurance contract but found the office in darkness, with a sign on the door saying they closed at 12 noon. My insurance contract year is from July 1 to June 30 of the following year.

My second quarter insurance expired 12 midnight on December 31, 2020. Hence, I had to pay my third quarter payment by 4pm on December 31, 2020. While I was not able to drive my car on January 1, 2021 because of ICWI idiotic closure on December 31, 2020 at 12 noon. I however had great expectation that I could renew my car insurance on Saturday January 2, 2021 at the normal opening of 10:00am to 2pm. No such luck! The office was fully closed too on Saturday without any notice saying it was going to be closed. I went there and other customers were there in disappointment as well.

The usual reminder messages for my car insurance renewal by December 31, 2020, came to me about a week before. One phone text message and one voice message from a call centre agent. But none of which stated that they were closing at 12 noon on December 31, 2020, and on Saturday January 2, 2021. Also the notice on the office door that I also submitted into evidence did not state that they were closing on Saturday January 2, 2021. Hence there were three (3) consecutive Negligence by omission evidences that were presented to the court in no uncertain way.

As such I was not able to get my car insurance renewed until Monday January 4, 2021. I was unable to used my car to go about my business from 12:01am Friday January 1, 2021 until Monday morning January 4, 2021. That resulted in damages to me that I sued for. On the Monday morning of January 4, 2021, other customers came to the office in my presence complaining about the same idiotic closure and the inconvenience suffered. At the time ICWI did not offer and made known any alternative method of renewal such as by the internet.

Prior to going to court I wrote to ICWI on the issue and asked for redress for the inconvenience suffered. The letter was addressed to the head of the legal department, Ms. Suzette Radlein to addressed the matter with the management. After some weeks and despite a reminder letter sent there was no reply. The highly corrupt lawyer, Suzette Radlein displayed no regards for the rights of the customers who are paying her salary at the end of each month that she is dependent on for her survival. That is the treatment to a customer who is with the company for over 25 years and absolutely no liability to the company.

In the court case corrupt ICWI Representative Lawyer, Miguel Palmer failed to file and serve a defense. The only thing he filed and serve was the two reminder messages, the text message and the voice message which I had already admitted in my Particulars of Claim.

At the trial on June 21, 2023, Miguel Palmer choose to put up an oral four (4) points defense as documented by me and the Judge. After my testimony of my case and cross examination of me, Miguel Palmer call one witness to the stand, the call centre representative, Mrs Venice Stenneth Clarke, who sent out the two reminder messages. That in itself was to their disadvantage as none of the two messages said anything about their closure on those days as admitted by the witness. Real idiotic of Miguel Palmer. That which I already stated in my testimony and clearly documented in my Particulars of Claim. However, Mrs. Venice Stenneth Clarke went on to committed perjury on the stand, when she told the court that internet renewal was available at the time without any evidence to prove that. Neither I nor any of the other customers in the office on Monday January 4, 2021, who were complaining about their idiotic closure, were advised of any internet renewal option to get certificate or cover note.

Immediately after Venice Stenneth Clarke, The corrupt lawyer Miguel Palmer asked to discontinue/ end the trial. Clearly Miguel Palmer put up a fraudulent 4 points defense on his own. He failed to put anyone on the stand to answer to his defense, to be cross examined by me the Plaintiff. The Judge granted his wish and set date of July 13, 2023 for Judgement to be handed down without allowing me to make closing argument submission.

On July 13, 2023, I told the judge, Alicia McIntosh that I would like to make a closing argument submission before judgment. She facilitated that. I made it most importantly and abundantly clear to the criminal judge, Alicia McIntosh, that Miguel Palmer's 4 points defense is totally unlawful, as he failed to put anyone on the stand to answer to it, and there is no endorsement from the management of ICWI to his defense. That such a defense could only be answered to by a Senior Management personnel or one who is named in the articles of association of the company. I then requested that Miguel Palmer's fraudulent defense be set aside.

Can any professional judge, lawyer or any other educated person tell me why a judge would rule in favor of ICWI highly corrupt lawyer, MIguel Palmer??? A lawyer who clearly committed perversion of justice and to be criminally charged.

A large portion of Jamaican judges are some of the biggest criminals in Jamaica. They sell out court cases to their lawyer colleagues and deny the poor and the ordinary people of their rights in the court of law. It is so clearly understood why murders and other crimes are so high in Jamaica because the poor and the ordinary people have no choice than to find alternative form of justice. Any country that does not have a proper justice system where everyone is treated equally fair, crime must prevail.

Alicia McIntosh is such a criminal, from July 25, 2023, I requested a stamped copies of; the order, her reason for ruling/ judgment, the defense from Miguel Palmer and my closing argument submission. To date they are in hiding from me in collusion with the corrupt Court Administrator, Marlon Malcolm. Notwithstanding, if Alicia McIntosh, ICWI and its corrupt lawyers, and Marlon Malcolm think they are getting away with their corruption they are making a very, very big mistake!! In the criminal Alicia McIntosh order she failed to state an order in relation to the Negligence that I put before the court, she instead wrote "Judgment in favor of defendant." Total corrupt sell out, no relation to what was before the court. The criminal totally ignored that in law, the order must clearly relate to what was before the court.

Clearly ICWI management gone senile to the very business they are in, to be still conscious that the insurance business is not the same as fast food restaurant, a gas station or a supermarket, where when one is closed you can go get service from another that is open. Insurance is a highly specialized business, not even another insurance company that was open could provide a substitute cover note for ICWI. All other businesses were open on those days including other insurance companies and even the government post office, while only ICWI choose to close office and send their workers to go enjoy life, with no regards for its customers. ICWI was the most disgraceful customer service business!
