Q1. What inspired you to specialize in agrarian law?

Agrarian law is a critical subject in Mexican law, especially considering that over 50% of the national territory is ejido land or communally owned. This fact inevitably influences various processes in investments, including those from foreign entities. Nowadays, almost all types of projects—whether in mining, tourism, real estate, or energy—encounter issues related to agrarian law. This is due to the ownership status of the land, which often involves ejido (common lands), communities, ejidatario, and co-owners.


Q2. Over 26 years of practice, what are the most significant changes you've observed in Mexican agrarian law?

Over my 26 years of practice, I've observed various significant changes in Mexican agrarian law. One of the main shifts is in the mindset of ejidatarios (common-land owners) and ejidos, who are now more receptive to different kinds of investments. However, it's crucial to note that investments in mining, tourism, real estate, and energy sectors must achieve a balance among all parties involved. Additionally, investors need to be well-informed, as this is a highly specialized area. It's imperative to engage expert lawyers in agrarian law who can provide constant advice and take necessary and objective preventative measures.


Q3. Can you describe a particularly challenging case you worked on in agrarian law and the outcome?

There have been several; in fact, each case presents its own unique challenges. However, a common issue I've encountered involves projects, particularly those led by foreign investors, that suffer due to poor legal advice. Often, these investors are misguided by law firms lacking expertise in agrarian law, resulting in significant oversights in their recommendations. This frequently leads to project failures and necessitates substantial additional expenses, adversely impacting the investment.


Q4. As a co-author of several publications, what is the key message you aim to convey about foreign investment in ejido lands?

In fact, one of my principal publications, titled “Inversión extranjera en tierras ejidales” (Foreign Investment in Ejido Lands), conveys a crucial message to foreign investors. I emphasize that investing in ejido lands in Mexico can be safe, but it requires caution. Investors must take key preventative measures and work with expert lawyers in agrarian matters to legally safeguard their investments. Additionally, near shoring, especially for major energy projects, necessitates significant infrastructure development, including the need to address easements or rights of way on ejido land. This underscores the importance of being familiar with agrarian law issues to navigate these complex legal landscapes effectively.


Q5. How has being a member of the Mexican Bar Association and the Agrarian Law Commission influenced your professional development?

Being a member of the Mexican Bar Association and the Agrarian Law Commission has significantly influenced my professional development. It has provided me the opportunity to engage with other lawyers on various contemporary issues and to understand the diverse challenges faced by law firms. Additionally, it has enabled me to become acquainted with various authorities in the agrarian sector.


Q6. How do you balance the needs of economic development with the protection of ejido rights?

Balancing economic development with the protection of ejido rights is indeed a crucial aspect of my work. As indicated in the question, any investment must be approached by seeking a mutual understanding among all parties involved. This approach is essential to maintaining a controlled social environment, which, in turn, is key to ensuring the viability of the project.


Q7. In your teaching career, what was the most valuable lesson you imparted to your students?

In my teaching career, the most valuable lesson I imparted to my students was the importance of striving for balance in projects. It's crucial to ensure that all parties involved, including ejidos and investors, work together to create a positive social environment. This collaborative approach significantly impacts the project's future success.


Q8. From your vast experience, what has been your most rewarding achievement in your legal career?

From my extensive experience, there have been several rewarding achievements. However, the most gratifying aspect for me is witnessing a project's successful consolidation and knowing that the investor or client has achieved their expected outcome.


Q9. Looking ahead, what future projects or goals are you most excited about in your field?

Looking ahead, there are several exciting prospects in my field. Particularly, I am most enthusiastic about projects within the mining, energy, tourism, and real estate sectors. These areas are not only dynamic and evolving but also crucial for economic development. In mining and energy, the challenges of sustainable and ethical practices present opportunities for meaningful legal work. The tourism and real estate sectors, on the other hand, offer unique challenges in balancing development with environmental and social responsibilities. I look forward to contributing my expertise to these sectors, helping to navigate the complex legal landscapes, and ensuring that growth and development in these areas are legally sound and sustainable.
