The basics to family law
???????????????Family law encompasses a wide range of legal issues that revolve around relationships and family dynamics. From marriages and divorce to child custody and spousal support. Understanding these complexities is crucial for individuals facing any of these challenges. We want to explore the key aspects of family law and its various components to provide insight on how an individual can navigate this complex environment.
Marriage and civil unions:
??????????????? Hopefully you have a familiar understanding about marriage and civil unions but understanding what prenuptial and postnuptial are important. There are misconceptions about both; the one we’ve heard is that it likely means a party is likely going to cheat, but in reality, it means that a party is protecting itself and its assets. There is nothing wrong with getting a “prenup” or “postnup”. A “prenup” happens before the marriage, while a “postnup” happens after the marriage. Both add a safety barrier for parties and their assets should parties come to an understanding that the relationship isn't going to work. This usually is a list of assets that will remain in one parties possession after the end of the marriage or union. This can be money, businesses, alimony, pets, property, etc.
Divorce and separation:
??????????????? Divorce and separation can happen for several reasons. Contentious divorces are ones that go to court, Joint petition divorces are divorces where both parties agree to terms of their divorce. Whether this is a split of assets or wealth depends on both parties involved. This usually ends up being the less “intense” form of divorce as both parties are ready to walk away and willing to make it as easy as possible. It is helpful to hire a lawyer for both forms of divorce so you can help ensure things go smoothly and you are protected in the future. One misconception we've heard is that both parties in a divorce or separation believe they need their own lawyer, but in reality both parties can go to the same lawyer if they choose. This can smoothen out the process and even be cheaper!
Child custody and support:
??????????????? Legal custody is the right to make decisions about your child. Child custody and support is something better determined by your lawyer as it can range based on the clients. We have seen cases of minimal to maximum support needed. There are multiple types of custody such as sole legal custody and joint legal custody.
