Ayala is happy to announce that it has defeated a motion to dismiss its client’s claim for over $1 million for work performed at the defendant’s Fort Lauderdale mansion, a property now listed for? $40 million.
The case involved the build-up of a Fort Lauderdale waterfront mansion where Ayala’s client, a contractor, was hired to perform the shell work. After making numerous changes to the original plans, the owner refused to pay for the additional cost of changing the plans and adding a series of improvements to the property.?
Ayala’s client sued the owner, alleging a breach of contract and other theories based on common law.?The owner moved to dismiss and to disgorge all the funds that had been paid ($1 million), alleging (falsely) that Ayala’s client performed unlicensed work.?
Attorney Eduardo A. Maura and Levi Harris are involved in the case.? Attorney Eduardo stated, “We are very happy with the result. Though you would think the evidence is clearly on our side, it is never easy. It was a tough, two-hour battle, and we are happy that the judge was able to see through the defense's hollowed arguments. We hope that the defendant will now come to the negotiating table with meaningful offers.”?
