Upon reviewing thousands of RFE's, we have identified a few preventive measures that may help avoid an RFE under most circumstances.

Beneficiary's Qualification

Ensure the beneficiary is qualified for the position by including a Foreign Academics evaluation. If the beneficiary's Degree is in an unrelated field, include a work experience evaluation by a Professor in the discipline relevant for performing the job duties, who is authorized to grant life experience credits.

Specialty Occupation Nature of the Position & Beneficiary's Suitability

Avoid disparate Degree disciplines requirements as a prerequisite for the position. Ensure the job duties performed by the beneficiary are detailed and complex enough and falls under the appropriate SOC code while initiating the LCA. Include a Specialty Occupation Position Evaluation by an industry experienced Professor with expertise in the relevant discipline.

Availability of Specialty Occupation Work

Include evidence to establish availability of specialty occupation work for the requested period.
