Authority & Functions of the President.
Following the Constitution, the President fulfils various roles and responsibilities. As outlined in clauses 131 and 132, these include serving as the head of state and government, the commander-in-chief of the military, and the symbol of national unity.?
The President's main functions encompass a range of duties. Firstly, as the head of state and government, the President wields executive authority over the Republic, working in collaboration with the Deputy President and Cabinet Secretaries. Additionally, the President assumes the role of commander-in-chief, overseeing the Kenya Defence Forces.?
Furthermore, the President assumes the position of chairperson for the National Security Council, ensuring the effective functioning of national security matters. Moreover, the President acts as a symbol of national unity, actively promoting and strengthening the unity of the nation.?
The President also bears the responsibility of respecting, upholding, and safeguarding the Constitution of Kenya, ensuring its integrity is maintained.

Foster and Enhance National Unity: The President is tasked with fostering and enhancing national unity
Promote Respect for Differences: The President is responsible for promoting respect for the different people and communities of Kenya

Deliver an Address to Parliament: Following each general election in Kenya, the President must deliver a speech at the opening of each newly elected parliament and may also address a special session of Parliament once a year
Authority to Nominate and Appoint: The President holds the authority to nominate and appoint various public officials, including Cabinet Secretaries, Attorney-General, Secretary to the Cabinet, Principal Secretaries, and diplomatic and consular representatives, subject to approval by the National Assembly.
Ministries and government departments have various responsibilities and functions. One of these is the assignment of responsibility for the implementation and administration of Acts of Parliament. This can be done by the President, who can delegate this task to a minister or other public officer.
In addition to this, the President is also authorized to perform any other executive function as outlined in the Constitution or national law. This allows for flexibility and adaptability in the execution of governmental duties.
Furthermore, the President holds the power to grant pardons to individuals who have been convicted of offences. This power of mercy allows for the possibility of leniency and forgiveness in certain circumstances.
It is important to note that the President enjoys legal immunity, except in cases involving crimes under international treaties that Kenya has ratified. These treaties explicitly prohibit impunity for heads of state, ensuring accountability and justice.
