The ongoing evolution of the transactional risk insurance claims landscape

In 2023, the world witnessed a significant surge in claims on transactional risk policies, which insure against merger and acquisition deal risks. This rise came both in terms of claim frequency and the total amount of payments, and the trend has been particularly notable in the realm of representations and warranties (R&W) policies, also known as warranty and indemnity outside of North America.

The nature and scale of R&W claims are changing, creating new uncertainties for transactional risk insurance. Demand for this insurance remains strong, but the full impact of these claims may take years to be fully realized.

To shed light on these developments, Marsh has released the Global Transactional Risk Insurance Claims Report for 2024, which analyzes trends observed in 2023 using Marsh's extensive claims data. It provides valuable insights into the evolution of the claims landscape, the influence of macroeconomic factors and mergers and acquisitions on claims and the implications of claims outcomes on transactional risk insurance.
