Attention all visa holders and employers! Significant changes are coming to visa conditions 8107, 8607, and 8608 as part of the Australian Government’s Migration Strategy. These changes aim to address worker exploitation and enhance productivity. Here’s what you need to know:

Key Updates:

  • These changes affect holders of Temporary Work (Skilled) visa (subclass 457), Temporary Skill Shortage visa (subclass 482), and Skilled Employer Sponsored Regional (provisional) visa (subclass 494).
  • Visa holders who cease working with their sponsoring employer will now have up to 180 days at a time, or a maximum of 365 days in total across the visa grant period, to find a new sponsor, apply for a different visa, or arrange to depart Australia.
  • During this time, visa holders can work for other employers, even in occupations not listed in their most recent sponsorship nomination, allowing them to support themselves while seeking new opportunities.

Important Considerations:

  • Visa holders must cease work with their current sponsor before working for another employer unless exempt.
  • While with their current sponsor, visa holders must remain in their nominated occupation.
  • Sponsors must notify the department of any changes within 28 days, including cessation of sponsorship or resignation of a visa holder.
  • Visa holders must comply with any licensing or registration requirements for their nominated occupation.

Who Is Affected:

  • These changes apply to both existing visa holders and those granted a visa on or after 1 July 2024. Any periods of non-employment before this date will not count towards the new time limits.
