Attention Data Brokers: New Lawsuits Are Targeting You!

On January 6, 2024, New Jersey enacted a data privacy law to protect law enforcement personnel.? This law protects the privacy of law enforcement personnel from having their private personal information in databases. All that a New Jersey law enforcement personnel has to do is make ONE request to a data broker to have its private personal information removed its database.? The data broker then has 10 days to remove the requested personal information from its database. It the data broker fails to do so in such time, then the New Jersey law enforcement officer can seek $1,000 in civil statutory damages.? This New Jersey law is known as Daniel’s Law.? It makes great sense in order to protect law enforcement personnel from having an assault, battery, death threats, or something worse to them and their families from individuals seeking to know where they live.? It is an opt-in protection offered to law enforcement personnel, and data brokers have 10 days to comply with their takedown request.? It has been well received, and there is a movement to pass a similar federal law to protect all law enforcement personnel.
It appears that many data brokers were not aware of this new law, and there have been over 100 recently filed lawsuits against data brokers seeking Daniel’s Law’s $1,000 civil statutory damages per violation.
