Assuring that the California Dream Continues to Thrive for Everyone is Vital, SB 1047 (Wiener) Needs a Veto

An Open Letter to Governor Gavin Newsom

California is the bellwether state for anyone who has dared to dream and succeed. It is the nation’s economic leader, and California is a global hub and model for technological innovation. Unequivocally, one of California’s greatest strengths is the ability to foster entrepreneurs that serve many Californians and beyond. A veto of SB 1047 assures that the California Dream continues to thrive for all of us.

On balance, both concerns and economic opportunities regarding artificial intelligence (AI) are legitimate. Finding a sensible approach to harmonizing both is important and delicate. Indeed, the Legislature attempted to address this challenge this year by introducing nearly fifty bills to regulate AI in 2024.

Some of these AI bills are well-intentioned but miss the mark altogether. SB 1047 stands out in this regard. It would overregulate AI through bureaucratic oversight by the California Department of Technology, force endless litigation through the California Department of Justice, and pile on penalties issued by the California Labor Commissioner’s Office. One does not have to be an AI expert to understand what SB 1047 does; it stifles the California dream for everyone by mandating the overregulation of AI.

Unlike other AI legislation, if not vetoed, SB 1047's negative consequences will be all too real for the many small businesses and the consumers they serve. Ever since the pandemic, many of our small businesses have increasingly relied on AI technology to find a way to survive and thrive. In California, small businesses make up more than 98 percent of the total businesses, employ close to 7 million people, and lead the nation in business startups.

“Measuring twice, cutting once” is a crucial rule to follow when addressing significant public policy issues with irreversible consequences. SB 1047 falls far short of this test. It needs to be vetoed, and policymakers must go back to the drawing board to find the right balance between protecting the public and assuring the California dream continues to thrive for everyone. #cagoverner #GavinNewsom @gavinnewsom @CaGovernor
