ASQA SHB Transition Extension - FOI Drop #12
12th instalment of documentation secured under FOI application regarding ASQA's decision, just days before expiry, to extend transition period for SHB qualifications.

The ASQA brief, documenting how the decision was made.
Review of the brief raises some key items of interest.
1. Timeliness
Dated 5 December 2022, if this brief was so urgent, why 8 days before it was signed (13 December 2022).
Or for that matter, why did it take this long to write?
The first formal submissions for extension were coming in May 2022. ASQA's own email feedback consultations received most responses in the first week of November, with the last response 9 November - another 4 weeks to write a short brief?
2. Wrong date...
The brief claims that the RTO 3789 requested an extension to 31 January 2024. That is incorrect. The RTO actually requested an extension unti 31 December 2023.
Why is that important?
Apart from accuracy (this is a Commonwealth Government document after all) there are multiple feedback submissions from RTOs stating that any extension into 2024 would be "unfair" "excessive" and "inconsiderate."
In fact none of the formal web submissions received by ASQA requested that date.
So where did that date come from?
Well we now know it was actually from WA TAC - view the documentation .

3. There's that claim of support again
"... has been attributed to support from the Personal Services IRC"
There was not support for a blanket extension. We now know the SkillsIQ SSO Personal Services IRC says No. No. No. No . And then ASQA did it anyway.
4 The provider feedback stats are not accurate
The brief claims that of 30 RTOs responding [our analysis identifies 24]:

5. The decision not formally recorded
The brief does not actually record the decision. "Agreed / Not agreed" remains unaddressed.
6. Consultation with other VET regulators
The FOI document package reviewed did not seem to evidence any direct consultation with other VET regulators.
There was correspondence from WA TAC telling ASQA what it was doing. Someone telling you is consultation? Or just FYI?
ASQA indicated in internal communications that it had consulted, but there is no records / minutes of these activities evident.
So we have:
Looking at this situation, was ASQA's Executive Director - Quality Assurance & Market Entry appropriately informed when making the decision?
