ASQA In Parliament
Today, Andrew Laming MP, the member for the Queensland seat of Bowman made a series of startling revelations to the Federal Parliament concerning #ASQA. Laming's speech outlined a detailed investigation into auditing and litigation practices concerning RTOs. Interestingly, it reflected the experiences of many clients.
Laming was correctly respectful of the role that ASQA plays in maintaining the integrity of the #VETSector. However, he also outlined examples and experiences of other RTOs that included the difficulty of the AAT appeal process and incoherent audit practices by the regulator.
Today's speech starts an important conversation about the integrity and sustainability of the Australian education market. A conversation where all stakeholders - regulators, providers, institutions and students all have skin in the game.
In the meantime; I repeat what I always say that it is important for all RTOs to maintain healthy relations with ASQA. In the event that the regulator has made a 'D Day' decision concerning your RTO, commence an appeal as soon as possible to ensure the best possible outcome in the AAT.

5 年Peter, I liked your article. In relation to your closing statement concerning an ASQA 'D Day' decision against an RTO. It is also important when seeking a merits review (in regards a decision that is subject to review) that the RTO also consider an application for a stay order.

5 年It would be very interesting to trace the rise of ASQA and compare it to historical precedents such as the Star Chamber of the 15th Century. Originally created to protect the more prominent citizens against what was perceived as unfair judicial treatment by lower courts, in its earliest days the Star Chamber was well regarded for its rulings on justice and fairness, but evolved into what many viewed as an oppressive and controlling totalitarian instrument of the state. It is a shame that under current conditions there is an appearance that the mighty and the powerful have been allowed to get away with committing the most egregious sins against the VET state, while the weak and the powerless are being ruthlessly pursued. The question many would be asking is whether we are entering into a very black period in the history of education in this country, and what can - must - be done about it. Will the politicians hear Andrew? i fear that, unless the issue is kept before them, it will quickly become yesterday's news.

5 年One of the best articles I have read regarding a completely unfair and unethical regulatory system we have in Australia.?

5 年About time I have been thinking for a long time that we are all in a crazy virtual reality known as the Emperors Clothes. So many clients have this experience of unfair and illogical audit decisions, registration holds ups and processes requirements that shift on a daily basis.
