1.??? UN Releases Proposed Framework for Global AI Governance, Emphasizing the Critical Role of Standards

“Governing AI for Humanity” is based on insights from more than 2,000 participants across regions of the globe, highlighting AI’s transformative potential and outlining principles that will guide the formation of new international AI governance institutions.

Notably, the report outlines a blueprint for addressing AI-related risks, including calling on all governments and stakeholders to work together in governing AI to foster development and protection of human rights. Among the key recommendations for global AI governance, the advisory board recommends an AI standards exchange, as noted on page 55 of the report.?

2.??China proposes new regulation on labeling AI-generated content

The Cyberspace Administration of China (CAC) has released a draft regulation that aims to standardize the labeling of AI-generated synthetic content to protect national security and public interests.

Under the draft regulation, internet information service providers must adhere to mandatory national standards when labeling such content. Providers offering functions like downloading, copying or exporting AI-generated materials must ensure that explicit labels are embedded in the files.

Platforms that distribute content are also required to regulate the spread of AI-generated materials by offering identification functions and reminding users to disclose whether their posts contain AI-generated content.

3.???China Publishes Finalized Regulation for Administration of Network Data Security

China has officially published the finalized Regulation for the Administration of Network Data Security (Network Data Regulation), which will take effect on January 1, 2025.

Key highlights include stricter informed consent requirements, clearer definitions and obligations regarding "important data," and expanded contractual requirements for data sharing between data handlers. Cross-border data transfer exemptions have also been introduced, making certain transfers possible without government assessment under specific emergency or statutory circumstances.

4.??? Singapore Supreme Court Issues Guidelines for Gen AI Tool Use

Singapore’s Supreme Court issued a set of guidelines for the use of Generative Artificial Intelligence (Gen AI) Tools by Court Users on September 23, 2024. The guide, implemented on October 1, 2024, outlines general principles and guidance in relation to the use of Gen AI tools in case of Supreme Court proceedings. However, previous implementations of such guidelines in other countries highlight struggles with ensuring personal data safety.

Court assumes neutral stance on Gen AI:?In the general principles, the guide states that the court “maintains a neutral stance” on the use of Gen AI tools.

Gen AI not to be used for evidence:?The guide allows users to employ Gen AI tools to prepare court documents but also instructs them not to use the tools to generate any evidence “that you wish to rely upon in Court.” The guide also instructs the user to ensure accurate and fact-checked information and adhere to intellectual property rights while using the tools. The court also instructs the user to inform the court when using Gen AI tools for court documents.

5.??? Launch of AIGE Guidelines: Promoting Responsible and Ethical AI Governance in Malaysia

The launching of Artificial Intelligence Governance and Ethics Guidelines (AIGE) was held on 20th September 2024 at the Putrajaya Marriott Hotel.

AIGE is a framework designed to ensure the safe use of AI technology through compliance with the seven principles of responsible AI. These guidelines focus on three categories, which are the end users (the public), policy makers, and developers and technology providers. It is an important component to support the development and use of AI in addition to raising awareness and promoting responsible AI compliance throughout the country using the principles of “AI for Malaysia, AI for All”.

6.??? Australia: Children’s Online Privacy Code is coming

A key initiative in the Bill is a mandate for the OAIC to develop a Children’s Online Privacy Code, which would centre children in the debate around privacy in Australia and help to harmonise protections with those children already benefit from in other countries such as the UK.

The code will apply to social media and a wide range of other internet services likely to be accessed by children, including apps, websites and messaging platforms. It will specify how these services must comply with the Australian Privacy Principles, which are the cornerstone of the privacy protection framework in the?Privacy Act 1988. The code may impose additional requirements provided they are not inconsistent with the existing principles.

7.???South Korea: PIPC Recommends Systems Processing Vast Amounts of Personal Data in the Public Sector Take Higher Data Protection Safeguards

The Personal Information Protection Commission (“PIPC”) held the 15th plenary meeting to reach a resolution to issue recommendations on a total of 35 civil service systems across the country in the domains of real estate, local taxes, etc., and public sector entities that use the systems to put more stronger safeguards in place. The resolution is made as a result of overhauls of the personal data processing systems and entities in the public sector subject to taking measures to ensure safety.

The PIPC established and announced a couple of plans that include “Measures to Prevent Data Leakage in the Public Sector” and “Plans to Achieve Higher Data Protection Standards in Systems Subject to Intensive Management” in collaboration with relevant agencies to cope with challenges caused by personal data breaches in the public institutions processing vast amounts of personal data resulting in severe and irrevocable damages. Since the last year, the data protection supervisory authority has been conducting inspections on the operating agencies subject to intensive management as part of the plans scheduled to be implemented for three years from 2023 to 2025.?

8.??South Korea announces signing of letter of intent with Germany for IoT security certification

The Korea Internet & Security Agency ("KISA") announced on Wednesday, September 11, 2024 that it has signed a letter of intent to cooperate with the German Federal Office for Information Technology Security* (BSI) for mutual cooperation on Internet of Things (IoT) security certification systems with the support of the Ministry of Science and ICT.?

The purpose of this letter of intent to cooperate is to confirm the will of both countries to conclude mutual recognition of IoT security certification systems, exchange best practices in the two countries' certification systems, cooperate on IoT security technology standards, and promote mutual recognition evaluation. Based on this, the two countries hope to conclude an 'Internet of Things (IoT) Security Certification System Mutual Recognition'.
