The Delhi High Court recently dismissed a plea challenging the arrest of Chief Minister Arvind Kejriwal in connection with a money laundering case linked to the excise policy scam. The court ruled that the plea was not maintainable, stating that Kejriwal had the means to approach the court through appropriate legal channels.
The high court's decision, made on May 1 but detailed in a recent verdict, highlighted several key legal points. It emphasized that the petitioner lacked the standing to seek relief for the arrested person, citing a previous dismissal of a similar public interest litigation (PIL). The court also underscored the legal requirement for arrested individuals to be produced before a magistrate within 24 hours and highlighted the existing rules in the jail manual governing the rights of undertrial detainees.
Additionally, the court addressed the petitioner's plea for the Election Commission of India (ECI) to be informed about arrests of political leaders during the model code of conduct (MCC). It noted the petitioner's misunderstanding of legal principles, stating that such directions were outside the court's purview and legislative in nature.
While considering imposing costs on the petitioner, the court ultimately exempted them due to the petitioner's status as a law student. However, the court dismissed the plea seeking permission for arrested political leaders to campaign virtually during elections, cautioning against potential misuse of such permissions by criminal elements.
The case stems from Kejriwal's arrest by the Enforcement Directorate in March in connection with the Delhi excise policy-related money laundering allegations. The petitioner expressed concern over the timing of arrests during election periods, citing infringement of both electors' rights to information and politicians' campaign rights.
The high court's ruling underscores the legal intricacies surrounding arrests of public figures during sensitive periods like elections, emphasizing the balance between legal procedures and constitutional rights.
