The Art of Litigation and Trial is knowing the difference between realistic and achievable goals and desires borne out of emotions. The trial lawyer must not only strive to present the best story, but must ensure that the client is in tune with reality. Courts have great power, but the common denominator is usually money. On the civil side, the Court either awards or declines to award money as the recompense for damages. Clients need to understand that dynamic. The more the case costs align with probabilities of success, the more likely the client will deem it worthwhile. But litigation should be filled with options. Assess realistic and long-shot results. Don't be afraid to go for the brass ring, even if the real purpose is to soften up the opposition to accept more realistic goals for settlement.
