?High Court Case - Human Rights and Immigration in the Media

This is connected to the Deportation Bill which?was rushed through Parliament to address any adverse High Court decision of the ASF17 case. The Deportation Bill is currently before the Senate. The Deportation Bill has been branded as “over-reach ” and has raised great concerns from Human Rights groups.? The Bill proposes that the Minister for Immigration be equipped with new powers to force a person to cooperate with being deported from Australia and prevent people from certain countries from entering Australia. You can read the concerns raised by various stakeholders, including the Asylum Seeker Resource Centre , Human Rights Law Centre , Law Council of Australia , and ?Kaldor Centre for International Refugee Law . ?
Construction Industry Skills Shortages
Skills shortages in the Construction industry and ?trades are still featuring in April news .
The Master Builders Association has released its Recommendations which identify skilled migrants as a real solution to addressing this crisis.? Other? Industry specialists, such as Build Skills Australia, also commenting that overseas skilled tradies are required this demand.

Draft Core Skills Occupation List for work visas - Jobs and Skills Australia
As reported in our March edition, Jobs and Skills Australia (JSA) are undertaking a consultation relating to those occupations that should be included in the Core Skills Occupation List (CSOL) for the new Skills in Demand Visa (SIV) (the new work visa sponsorship). The SIV is the birthchild of the Government's Migration Strategy , with the SIV to be implemented by the end 2024.

New Points Test – Discussion Paper
On 23 April 2024 the Government issued a Media Release sharing its discussion paper ?for consultation on the Review of the Points Test.? Submissions are to be lodged by 5pm, Friday 24 May 2024.
The Points test is the backbone of General Skilled Migration; it is how migrants qualify for Australian Permanent Residence independent of employer nomination.
It is vitally important to Australia’s visa landscape, forming about two-thirds of the migration program .
The discussion paper invites replies to 7 critical questions :
·???????? QN 1: How can we design the points test to best target migrant success in finding a skilled job?
·???????? QN 2: How can we better target points-tested visas to meet Australia’s skills needs?
·???????? QN 3: How should we redesign the points allocated to age to better select younger migrants?
·???????? QN 4: How should we design the points allocations for partners to best reflect their potential labour market contributions?
·???????? QN 5: How could the points test support gender equality in the Australian labour market?
·???????? QN 6: How should transition arrangements for the points test reforms work?
·???????? QN 7: How regularly should the points test be reviewed? What should reviews consider?

Regional Australia wins in April
Regional Australia has had some wins in April, with
128 new occupations?have been added to the?SA Regional DAMA, including construction and trades, agribusiness, ICT, health, education and renewable energy sectors. The occupation list can be found?here. ?
More positions are available: the nomination ceiling from 700 nomination places annually , has increased to 2000 places.
The variation will see a geographical expansion that includes an additional 41 local government areas across inland NSW to include regions of Riverina, Murray, Southern Inland & Central West.?
Additionally, the variation will provide for the development and growth of regional NSW expanding to 129 occupations under the Orana DAMA, giving businesses across 53 local government areas in NSW access to a broader range of skilled workers.

The NSW Government has relaxed its Pathway 1 nomination criteria for the Skilled Work Regional visa (subclass 491).? ?This adjustment will make the pathway more accessible to skilled workers living and working in regional NSW, to better support regional development and the local economy. Previously, applicants for Pathway 1 were required to have been living and working in a designated regional area of NSW for at least 12 months with a single regional NSW-based employer, among other requirements. Based on industry feedback, NSW are now reducing this employment duration requirement to 6 months.
