I just read this article today. In Minnesota, you CAN disinherit children, as long as you have specific language in your will to confirm this. The language I use is "I knowingly and voluntarily and intentionally disinherit my (child)...he or she is to take nothing under my will or from my estate
. It is NOT sufficient to merely not list the child to be disinherited. There will be a presumption, under the probate code, that it was a mistake and that all children were meant to inherit. Thus, you need the special language.
Also, as parents who write wills, when you have adult children, should consider putting language in the will that any inheritance is only meant to benefit your child and not the spouse of any child. This helps to protect your children if they are getting divorced after you pass. It helps prevent the division of your inheritance with you child's ex-wife (ex-daughter-in-law).

3 年After recently going through a situation with my parent's estate this hits home. What do you think about estate planning for spouses with "mixed families" (i.e. both spouses have children from previous marriages). Does this follow a similar line?
