Amendments to the 'Chair Law' in Mexican Federal Labor Law

Please be advised that on December 19, a decree amending articles 132, 133, 422, and 423 of the Federal Labor Law (LFT), known as the "Chair Law," was published in the Federal Official Gazette.

Key Amendments:

  • Employers must provide workers with chairs or seats with backrests for performing their duties or taking breaks.
  • Employers are prohibited from requiring workers to remain standing throughout their shifts or preventing them from sitting while working.
  • The reform aims to enhance working conditions and safeguard the health of workers required to stand for extended periods.
  • While this obligation was already outlined in the LFT, the reform strengthens workers' right to rest in a chair with a backrest.

Effective Date: This reform will become mandatory in June 2025, allowing a 180-day period for the necessary adjustments. Non-compliance may result in fines ranging from 250 to 5,000 Units of Measure and Update (UMA) and the potential temporary suspension of business operations.

The Ministry of Labor will issue supplementary regulations on occupational risk factors within 30 days after the reform comes into effect. Companies are encouraged to begin preparations promptly to ensure compliance.
