In May 2019, we succeeded on appeal to the Court of Appeal and obtained an order to terminate the co-proprietorship between our clients and their extended family members on the basis of disagreements between the co-owners over many years. The Court of Appeal also ordered the sale of the property at market value and the distribution of sale proceeds according to the co-owners’ shares in the property.
We are pleased to share that yesterday our team comprising lead counsel Raymond Mah together with our Prisilla Chong, Kar Men Fung and Chew Jin Heng successfully opposed an application for leave to appeal to the Federal Court brought by the co-owners to challenge the Court of Appeal's decision.
Hence, the Court of Appeal’s judgment which has been reported as Leong Wai Choong & Ors v Mah Guat Eng & Anor [2020] MLJU 1022 remains good law.
