It is all about the light… about the light … about the light!

No need to remain in the dark anymore … come into the light!

 

Firstly, just to let you know this is not another Covid-19 related article - I know most of us are getting bored and a little fed up of seeing Covid-19 everywhere. So, I thought I would write about something else for a change and I came across an interesting read, on right to light.

 

For those of you who are unsure of what I mean by right to light, it is literally what it says “right to light”. For instance, if you have a property, that property is entitled to have a certain amount of light coming into it. However, sometimes the right to light can be interfered with for example if your neighbour decides to extend their property which results in blocking light to your property.

 

When the right to light is interfered with regardless of whether the work has been completed yet or not there are options available to prevent either further/future works or the removal of the works i.e. the extension or building that infringes your property right.

 

Whilst you can speak to the infringer regarding the issues in an attempt to resolve it, unfortunately, it does not always work! So, what next? An injunction! This is a remedy where the infringer would either be asked to take certain action or prohibited from taking certain actions. Injunctions are costly and carry severe catastrophic consequences, which believe me when I say, an infringer would want to avoid at all costs!

 

In a recent case of Beaumont Business Centres Ltd v Florala Properties Ltd [2020] EWHC 550 the defendant had interfered with the Claimant’s right to light. This case serves as a prominent reminder that the risk of injunction in Right to Light matters is still very real.


Whether this is your neighbour or a developer the same rules apply!
