Risk factors to consider when evaluating programs and policies:

Providing specific resources exclusively to affinity groups: While supporting affinity groups can be beneficial, ensure the resources or programs are inclusive and don't inadvertently exclude other groups based on race, sex, or other protected characteristics.

Role definitions being defined by specific diversity-related characteristics: It’s critical that job descriptions and roles are based on the actual skills and qualifications required for the role, rather than assuming certain characteristics must be present to fill a position.

Board members selected based on diversity-related characteristics: Although diversity on boards is important for a well-rounded perspective, selection should still prioritize skills, experience, and qualifications. Be mindful of how diversity criteria are applied.

Grants/Funding provided based on diversity-related characteristics: Offering grants or funding for diversity-focused initiatives can be positive, but care must be taken to ensure these actions comply with Title VII and do not discriminate against other groups.

Be proactive by taking these steps:

Know the law: Understand the nuances of Title VII and other applicable federal and state regulations. Stay updated on the latest rulings and best practices to ensure your company is compliant.

Know your programs: Assess your employee lifecycles and review all company policies and benefits. Specifically focus on recruitment, selection, onboarding, compensation, separation, internal mobility, and retention initiatives to ensure they are free of discriminatory practices and applied consistently.

Be Courageous and assess your level of risk tolerance: Now is NOT the time to do stand still. It's critical to understand where your company stands in terms of diversity and inclusion initiatives.

Fit your programs into the law: Determine how much risk you’re willing to take in promoting diversity while ensuring compliance with anti-discrimination laws.

In "people-first" cultures, the most important thing is ensuring your talent strategies are a reflection of your company’s core values.

Final tip: Know who you are as a company: Diversity and inclusion efforts should align with the company’s overall mission and guiding principles, rather than being a compliance-driven exercise.

Deploy a winning strategy: By proactively assessing these factors, employers can reduce legal risks while strengthening their "people-first" culture, enhancing inclusivity, tapping into diverse talents, and thriving— all while staying aligned with both legal requirements and company values.
