Alert! Grace Period ELD Violations

Did you receive an ELD-related violation during the "soft enforcement grace period"?

In November 2017, FMCSA Director of Compliance and Enforcement Joe DeLorenzo announced that an ELD enforcement grace period would be granted between 12/18/17 to 4/1/2018.

During this period, the FMCSA and CVSA said that any violations received would be recorded but would not affect a carrier's Hours of Service CSA BASIC Scores.
They omitted one little bit of important information.
They didn't say was that the process to not have them counted in a carrier's scores would be automatic.
So, any motor carrier who received a non-hours related ELD violation during this period would have to go through the DataQ process to have the violation points reversed.
We've checked about 110 different motor carriers CSA BASIC scores so far and these violations have been counted EVERY time in multiple jurisdictions.
We also don't think that the FMCSA is aware of the issue!

§395.15 Automatic on-board recording devices.
§395.22 Motor carrier responsibilities—In general.
§395.24 Driver responsibilities—In general.
§395.26 ELD data automatically recorded.
§395.28 Special driving categories; other driving statuses.
§395.30 ELD record submissions, edits, annotations, and data retention.
§395.32 Non-authenticated driver logs.
§395.34 ELD malfunctions and data diagnostic events.
§395.36 Driver access to records.
