The 2024 Pakistani government, allegedly formed through electoral manipulation under Chief Justice Qazi Faiz Isa's disputed guidance, is now attempting to amend laws to perpetuate injustice, corruption, and human rights violations

This proposed amendment is deeply concerning, as it potentially infringes upon human rights and fundamental freedoms, affecting the well-being and dignity of all individuals, regardless of their faith or background.

The proposed amendment has sparked concerns about its implications on human rights and justice, particularly considering Pakistan's predominantly Muslim population. Crimes against humanity, including those motivated by religious or ideological beliefs, are serious violations of international law 1.

The Rome Statute of the International Criminal Court defines crimes against humanity as acts committed as part of a widespread or systematic attack against civilians, including murder, extermination, enslavement, and persecution 1 2. These crimes are considered grave offenses against human dignity and are punishable under international law.

Given the demographic makeup of Pakistan, with over 96% of the population identifying as Muslim, any amendment that potentially infringes upon human rights or promotes discrimination could be viewed as contradictory to Islamic principles emphasizing justice, compassion, and equality.

Key Concerns:

  • Crimes Against Humanity: The amendment may perpetuate or enable acts that qualify as crimes against humanity, violating international law 1.
  • Religious Discrimination: The proposed changes may infringe upon the rights of religious minorities or promote sectarianism 2.
  • Justice and Accountability: The amendment could undermine efforts to hold perpetrators accountable for human rights abuses and crimes against humanity.

Quran: 2:62 :: "Indeed, those who believe, and those who are Jews, and the Christians, and the Sabians - whoever believes in Allah and the Last Day and does righteousness, they will have their reward from their Lord, and there will be no fear upon them, nor will they grieve"

Quran 5:69:: "Indeed, those who believe, and those who are Jews, and the Sabians, and the Christians, and the Magians, and those who associate - whoever believes in Allah and the Last Day and does righteousness, no fear will there be upon them, nor will they grieve"

Violations of Human Rights Any detention or action that infringes upon fundamental rights, without due process or just cause, is considered a violation 1. The International Covenant on Civil and Political Rights establishes the right to remedy and reparation for victims of gross human rights violations 2.

International Prosecution The International Criminal Court (ICC) plays a crucial role in protecting fundamental human rights, particularly in cases involving:

  • Crimes against humanity
  • War crimes
  • Genocide

The ICC can prosecute individuals responsible for such violations, including government officials and other perpetrators 3.

This constitutional amendment appeared to be the violation of article 6, article 7, article 8 and article 8 bis of The Rome Statute treaty of the International Criminal Court (ICC)

Article 6: Genocide

For the purpose of this Statute, "genocide" means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:

  1. Killing members of the group;
  2. Causing serious bodily or mental harm to members of the group;
  3. Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
  4. Imposing measures intended to prevent births within the group;
  5. Forcibly transferring children of the group to another group.

Article 7: Crimes Against Humanity

  1. For the purpose of this Statute, "crime against humanity" means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack:

(a) Murder; (b) Extermination; (c) Enslavement; (d) Deportation or forcible transfer of population; (e) Imprisonment or other severe deprivation of physical liberty; (f) Torture; (g) Rape, sexual slavery, enforced prostitution, forced pregnancy; (h) Persecution on political, racial, national, ethnic, cultural, religious, gender, or other grounds; (i) Enforced disappearances of persons; (j) The crime of apartheid; (k) Other inhumane acts of a similar character intentionally causing great suffering or serious bodily or mental harm.

Article 8: War Crimes

  1. The Court shall have jurisdiction in respect of war crimes in particular when committed as part of a plan or policy or as part of a large-scale commission of such crimes.
  2. For the purpose of this Statute, "war crimes" means:

(a) Grave breaches of the Geneva Conventions of 12 August 1949; (b) Other serious violations of the laws and customs applicable in international armed conflict; (c) Violations of the laws or customs of war in internal armed conflicts.

Article 8 bis: Crime of Aggression

(Adopted at the 2010 Kampala Review Conference, effective 17 July 2018)

  1. For the purpose of this Statute, "crime of aggression" means the planning, preparation, initiation or execution, by a person in a position effectively to exercise control over or to direct the political or military action of a State, of an act of aggression which, by its character, gravity and scale, constitutes a manifest violation of the Charter of the United Nations.
  2. For the purpose of paragraph 1, "act of aggression" means the use of armed force by a State against the sovereignty, territorial integrity or political independence of another State, or in any other manner inconsistent with the Charter of the United Nations.
