AI vs Humans: The Battle For Copyrights

With generative AI taking the world by storm, the new technology is just as exciting as it is scary. We've got everything from gorgeous artwork to deep fake videos swirling around the internet.?

Did I mention the lawsuits??

Getty Images is suing Diffused AI for training their platform on Getty content without permission or payment. But several platforms are in a similar discrepancy.?

But the battle that interests me most right now is about Copyrights.

Can you Copyright AI Content?

Currently, I teach several AI classes each month and the number one question is always "Can I copyright my AI work". **insert deep sigh**

The short answer is NO, but that is also a very nuanced answer that requires a little bit of expansion.

AI Writing

  • No: If you copy directly from the platform and use the content as-is
  • Yes: If you significantly edit the content and make it your own

AI Images

  • No: If you enter a basic prompt and allow the platform to do most of the creativity
  • Yes: If you enter a very detailed prompt with no artist?references and most of the creativity comes from a human
  • Yes: If you upload a photo that you took and use it as a reference image for the machine
  • Yes: If you take the AI image and edit it in an image editor to create something that looks very different from the original image
  • Yes: If you put the images in a book. The book itself can hold the copyright, but not the individual images.

THIS 10-MINUTE VIDEO FROM SAMSON VOWELS IS AN EXCELLENT BREAKDOWN OF CURRENT AI COPYRIGHT LAW

In the meantime, I recommend that you use ChatGPT for your content framework and put your best images inside a book.?

That's it for me; catch you on the flip side!
