This Week's Question is from Pete in Laguna Beach:

"Why does Crossover a) exclude people from California and b) hide it away under FAQs so that people get excited and waste a lot of time looking through Crossover jobs advertised with "work from anywhere" language? I understand the AB5 issue but why not work with people like me who have their own LLC or support people to set up their own?"

My Answer:

Hi Pete,

That's a difficult but important question: So this is the perfect place to ask it!

I should caveat that I am not a lawyer nor deeply knowledgeable on the minutiae of Californian labor laws, but I'm happy to share my understanding of the answers to your questions:

a) AFAIK, you have hit the nail on the head with your reference to AB5. (For those unfamiliar: AB5 is a Californian law introduced in 2020 addressing the classification of workers as employees vs. independent contractors).

The new classifications are such a departure from international and national norms that the only way for global recruiters like Crossover to legally continue hiring Californians would be to develop a completely different system just for one state of one country (albeit a significant one!)

Doing this would have been not only impractical, but also compromise Crossover's ability to give every candidate an equal playing field; which is critical to our mission. Because we don't play favorites—and we always comply with local laws—'switching off' California was a difficult but necessary decision.

Hopefully at some point we'll be able to switch it back on again—but in the meantime, I must admit that there's some poetic irony that for decades Californians have had a monopoly on world class tech jobs that the rest of the world couldn't access... and now the shoe is on the other foot, per se.

b) You're right, this is something we can and will improve - and I'm sorry to hear of the disappointment it caused you. FWIW, because Crossover doesn't advertise in territories where we're unable to hire (which includes not only California but also US-sanctioned countries like Iran and Russia), organic visitors from those countries represent a surprisingly small slice of our total traffic.

Because of this, the best solution would be localized IP-based messaging—since it's incredibly important for the <0.1% of visitors who hail from those territories, but entirely irrelevant to the other >99.9%. Nonetheless, it's something we're working on; thank you for reminding us of its importance.
