Artificial intelligence (AI) is rapidly expanding into many different fields, and its inclusion in healthcare has generated a lot of discussion and excitement. Artificial intelligence has the ability to transform our diagnosis, treatment, and management of diseases. From diagnosis and treatment to drug development and medical education, as artificial intelligence technologies continue to permeate every aspect of medicine, the requirement of a thorough and sophisticated regulatory framework becomes progressively critical.
Welcome back for my weekly investigation of the transforming potential of artificial intelligence in healthcare. This week's AI Horizons edition explores the crucial component of this expanding field: Artificial Intelligence (AI) Regulations. I will go over how the worldwide scenario of AI regulations is changing, the difficulties in developing sensible legislation, and the critical part legislators, doctors, and innovators must perform in determining the direction of artificial intelligence in the future of healthcare.
The Importance of AI Regulations in Healthcare:
In modern medicine, artificial intelligence has changed everything. The fast development of artificial intelligence in healthcare offers excellent possibilities as well as significant obstacles. Medical practice has already been much improved by AI’s capability to recognize patterns, handle enormous volumes of data, and generate accurate predictions. Main applications in healthcare include diagnostics, drug research, tailored treatment, and administrative chores. For example, AI algorithms are currently utilized to detect diseases such as cancer, diabetes, and heart disease with ever-great precision.
However, as artificial intelligence systems become more sophisticated, they also raise significant concerns about how they should be applied, who is accountable for their activities, and how to stop them from harming others. Other unanticipated factors, such as algorithmic bias, inadequate transparency and explainability, security and privacy breaches, and ethical considerations, are also of concern. AI regulations must be introduced to solve these issues and guarantee that innovation is not hampered or harmed.
The Regulatory Landscape: A Patchwork of Global Efforts
The regulatory landscape for AI in healthcare is still developing and fragmented globally. Key players include governments, regulatory bodies like the FDA and EMA, and international collaborations, all essential for creating comprehensive frameworks. Recent global efforts focus on integrating AI governance with national strategies, emphasizing data privacy, risk management, ethical consideration, and bias mitigation. Countries are working towards harmonized standards to ensure ethical AI deployment in healthcare, highlighting the need for proactive policies to address these challenges.
The United Kingdom: At the Forefront
The United Kingdom has been at the forefront of integrating artificial intelligence (AI) into healthcare, striving to balance innovation with ethical accountability. The UK's strategy for AI regulation in healthcare emphasizes safe, transparent, and effective AI use alongside encouraging innovation. In 2021, the National AI Strategy was launched, a decade-long initiative to establish the UK as a global leader in artificial intelligence. This strategy underscores the necessity of regulatory frameworks to guarantee that AI technology in critical industries such as healthcare adheres to ethical and safety standards.
Furthermore, the Medicines and Healthcare Products Regulatory Agency (MHRA) regulates medical devices, including AI-driven technologies, in accordance with the UK Medical Devices Regulations 2002. It employs a risk-based methodology to categorize and govern AI-enabled medical devices, necessitating that producers prove their goods' safety, efficacy, and dependability. In 2022, the MHRA released the Software and AI as a Medical Device (SaMD) Change Programme, which delineates updated protocols for assessing and regulating AI in healthcare.
The UK General Data Protection Regulation (UK GDPR) regulates the utilization of personal data in artificial intelligence applications, encompassing healthcare. Moreover, The UK's Centre for Data Ethics and Innovation (CDEI) has established ethical standards for the application of AI in healthcare, emphasizing justice, accountability, and the mitigation of prejudice. These guidelines prevent AI applications from worsening health disparities and promote equitable and unbiased healthcare results. The UK government intends to enhance its AI regulations in healthcare by establishing more explicit guidelines for adaptive AI systems that evolve, augmenting collaboration among regulators, industry stakeholders, and healthcare professionals, and increasing public trust in AI through improved transparency and accountability.
European Union: A Proactive Approach
The European Union (EU) has adopted a proactive approach to AI governance by introducing the Artificial Intelligence Act (AIA), which came into effect on August 01, 2024, with some provisions coming into effect in the next few months. The AIA aims to provide a regulatory framework that ensures AI's security and ethical use while promoting innovation. The regulation classifies AI systems based on risk levels, enforcing stricter rules on higher-risk applications, such as those employed in healthcare. The AIA plays a crucial role in healthcare by regulating AI tools for diagnostics, treatment recommendations, and patient care, ensuring safety and ethical standards are met. This helps protect patients from potential biases and errors, promoting trust and reliability in AI-driven healthcare solutions. The regulation requires AI systems to emphasize justice, accountability, and transparency in addressing bias, discrimination, and data privacy.
The United States: A Fragmented Approach
In the United States, the regulation of AI in healthcare is more fragmented. Although there is no comprehensive federal regulation for AI, various agencies are responsible for monitoring certain facets of AI use in healthcare. The Food and Drug Administration (FDA) regulates AI-based medical products, ensuring their safety and efficacy before market approval. The FDA has established criteria for developing and approving AI medical devices, encompassing algorithms for diagnosis and therapy recommendations. These principles underscore the necessity for transparency, data integrity, and ongoing monitoring to guarantee the sustained correctness of AI systems. The FDA continues to refine its policies to address the complexities of AI in healthcare, fostering innovation while prioritizing patient safety. However, the absence of a cohesive national regulatory framework results in supervision deficiencies, generating uncertainty for developers and healthcare providers.
In a recent article in Nature, 692 FDA, FDA-approved AI/ML-enabled medical devices were analysed for transparency, safety reporting and sociodemographic representation. The results confirmed a lack of consistency and standardisation. To date, over 950 medical devices driven by AI have been approved by the FDA for potential use in clinical ?settings
To cope with this, certain jurisdictions at the state level have implemented their regulations regarding AI in healthcare. For example, California has implemented the California Consumer Privacy Act (CCPA), granting residents enhanced control over their data, including healthcare information utilized in AI systems. Nonetheless, these state-level legislation frequently lack consistency, resulting in ambiguity regarding the legal obligations of AI developers and healthcare practitioners nationwide.
The Coalition of AI CHAI? have launched The Assurance Standards Guide serving as a playbook for developing and deploying AI in healthcare, providing actionable guidance on ethics and quality assurance.

China: Rapid Innovation with Caution
In China, artificial intelligence has been adopted as a fundamental element of innovation, especially in the healthcare sector. China is in the midst of rolling out some of the world’s earliest and most detailed regulations governing artificial intelligence (AI). These include measures governing recommendation algorithms—the most omnipresent form of AI deployed on the internet—and new rules for synthetically generated images and chatbots in the mould of ChatGPT.
However, in the West, China's regulations are often dismissed as irrelevant or seen purely through the lens of geopolitical competition when writing the rules for AI. Instead, these regulations deserve careful study on how they will affect China's AI trajectory and what they can teach policymakers worldwide about regulating the technology. The Chinese government has delineated a set of directives for AI development, prioritizing ethical considerations, safety, and the safeguarding of personal data.
Other Global Initiatives
Several other countries, including Canada, Australia, and India, are concurrently formulating AI rules. Canada's Directive on Automated Decision-Making establishes protocols for applying AI in public sector decision-making. In contrast, Australia has developed the AI Ethics Framework, which delineates guidelines for the ethical application of AI across several sectors, including healthcare.
South Korea has recently enacted a comprehensive AI law titled "Basic Law on AI Development and Trust-Based Establishment," making it the second country after the EU to implement such legislation. This law mandates transparency by requiring AI business operators to notify users when high-impact or generative AI is used and indicate AI-generated results. The law also emphasizes risk management, safety, and reliability measures for high-impact AI systems and grants the Minister of Science and ICT authority to request materials, conduct investigations, and order corrective measures if violations are found. Like the EU AI Act, it adopts a risk-based approach, ethical guidelines, transparency obligations, and standardization provisions.
India also strives to develop regulations and laws regarding personality rights, deepfakes, and software patentability. It is also highlighting court observations on utilizing AI to improve justice delivery. This underscores the importance of AI regulations in healthcare, emphasizing transparency, ethical considerations, and robust legal frameworks to ensure AI technologies' safe and effective use.
This new law highlights the global shift towards ethical and transparent AI systems, influenced by the "Brussels effect," with more countries expected to follow suit in 2025. However, despite these efforts, there is no universal standard for AI regulations, leaving a complex web of legal frameworks that vary depending on the region. This fragmentation poses significant challenges for global collaboration and healthcare providers working across borders.
Legal and Ethical Considerations in AI Regulations
Addressing its legal and ethical implications is crucial as we move forward to a future where AI is becoming an integral part of healthcare. Key considerations include:
·?????? Data Privacy and Security: Compliance with laws like GDPR and HIPAA is essential to protect sensitive patient data. Robust security measures and transparency in data usage are necessary to maintain trust.
·?????? Bias and Fairness: AI systems must be trained on diverse data to avoid perpetuating healthcare disparities. Regulations should mandate regular audits for bias and encourage monitoring for unintended biases.
·?????? Accountability and Liability: Clear guidelines are needed to determine responsibility for AI-related errors and ensure developers and healthcare providers understand AI decision-making processes.
·?????? Human Oversight: AI should assist healthcare providers rather than replace them, with regulations requiring that qualified professionals make final decisions.
The Future of AI Regulations: A Path Toward Global Cooperation
There is a clinical paradox. Medical information is freely available via the web but is unregulated. However, AI using the same sets of data will need regulation.
The healthcare industry generates about 30% of the world's data, and that number is growing faster than other sectors.?By 2025, the compound annual growth rate of healthcare data is expected to be 36%.?The number of wearable devices that collect health data has increased from 325 million in 2016 to over one billion in 2022.?More people are using the internet to find health information, and the proportion of people doing so is growing.?In 2022, about 52% of people in Europe searched for health-related information online, which will only increase. We need a way of accessing vast amounts of data and using AI to support medical workflows, diagnosis and management accurately.
The future of AI regulations in healthcare is anticipated to emphasise global collaboration to establish unified standards that tackle legal, ethical, and practical concerns. Regulations must effectively balance patient safety with the promotion of AI development, avoiding excessively onerous standards that could impede progress. The objective is to establish a healthcare ecosystem where human expertise and artificial intelligence collaborate to enhance patient care and health outcomes.
Developing a comprehensive regulatory framework for AI in healthcare will require ongoing collaboration among stakeholders, including governments, healthcare providers, and the technology industry. A human-centred approach is essential, viewing AI as a tool to enhance human capabilities. Responsible and ethical use of AI can transform healthcare and improve patient outcomes.
As a surgeon and futurist, I am excited about AI's potential to enhance healthcare; nevertheless, I acknowledge that its complete potential will only be achieved with careful foresight and responsible regulations. The future of healthcare involves a synergy between human expertise and artificial intelligence, and by implementing suitable and sensible regulations for AI, we may establish a healthcare ecosystem that is both innovative and equitable.

But, still some of my questions didn't get the Reply (It was about the differences between Trauma- Surgeon "As general surgeon, I consider it's my case" but Orthopedic going to perform surgical traumatology, which I do not agree till now; We general surgeons we know what we could find in Traumatic-Cases and could do if there is/are intra-abdominal or to the Chest injuries will the orthopedic open the Abdomen & manage, or Chest injury with Pneumo/Hemothorax will orthopedic act and treat these cases urgently or will call a general surgeon to manage the case? That was my question, what is going to perform only Bones-Fractures or also acting in Abdomen & Chest as well?

However I still have my concerns about trying to regulate it not only differently but mainly with an old and outdated framework and mindset. We need definitely new skills in the regulatory space too in order to be more adaptable and flexible when it comes to a high paced evolution. It is like building a plane while it is flying rather than regulating the automotive industry while everybody was still using horses…
