In this fifth article of the series, I focus on the European Union's regulatory approach to the use of Artificial Intelligence in law enforcement. The EU's document addresses the delicate balance between leveraging AI for public safety and protecting individual rights, particularly concerning biometric identification and social scoring systems.

AI in Law Enforcement: Opportunities and Risks:

  • AI presents significant opportunities for enhancing law enforcement efficiency and effectiveness. For example, AI can aid in processing large amounts of data for criminal investigations (Page 60).
  • However, it also poses risks, such as potential biases in facial recognition technologies and threats to privacy and civil liberties (Page 62).

Regulating Biometric Identification:

  • The EU proposes strict regulation on the use of biometric identification by law enforcement, especially in public spaces. The aim is to prevent mass surveillance and protect citizens' privacy (Page 65).

Prohibition of Social Scoring Systems:

Challenges in Implementing AI in Law Enforcement:

  • Implementing AI in law enforcement presents challenges, including ensuring accuracy, avoiding biases, and maintaining public trust (Page 75).
  • Policymakers and law enforcement agencies must work closely with AI experts to establish guidelines that uphold ethical standards and protect citizens' rights (Page 77).

Conclusion and My Perspective: The EU's approach to AI in law enforcement reflects a commitment to advancing public safety while safeguarding individual rights. As a corporate lawyer, I appreciate the careful consideration given to balancing technological benefits with ethical and legal concerns. It's imperative that as AI technologies evolve, they do so under a framework that respects fundamental human freedoms and privacy.
