"ADP HAS BRIBED ME NUMEROUS TIMES TO SELL SIMPLE IRA'S"
THIS IS MY RESPONSE TO ADP'S REQUEST FOR PRODUCTION
Many are aware that ADP sued me for violating my non compete but most are unaware that ADP Sued me again in June of 2019, shortly after a few articles were posted on LinkedIn. ADP Sued me in November of 2018 for violating my non-compete, exposing trade secrets and not returning company property. All of which are false. Then in June of 2019 ADP sued me again for Defamation, Libel, Slander and Tortuous Interference.
ADP's Lead Internal Threats Investigator Gregory Kohles swore "Under Perjury" that all of my statements were false. He wrote an affidavit stating he looked through ADP Files during the time I alleged this went on as well as all of my Case Files. According to his investigation and findings, he determined, "I'm Lying." Unfortunately for him, I am not and he knows it. Gregory Kohles, doesn't know this but I found 3 People he personally fired for forgery and fraud. The same exact statements I gave in an article are the same reasons he fired them, better yet, he lied under oath and said he knows for a fact that all of my statements are false.. My attorney is pushing for perjury which carries a minimum of 5 years in prison.
ADP requested my evidence to support my claims that "ADP Has Bribed me." So I am going to share it with them.
Definition of Bribe
1: money or favor given or promised in order to influence the judgment or conduct of a person in a position of trust
2: something that serves to induce or influence offered the kid a bribe to finish his homework
Bribe: to influence the judgment or conduct of (someone) with or as if with offers of money or favor : to induce or influence by or as if by bribery.
Statement
ADP holds nationwide corporate incentives and contests to promote the sale of “SIMPLE IRA’s.” Reps are offered bonuses, time off, gift cards, electronics, etc. to sell SIMPLE'S. Many of ADP’s annual incentive trips such as Presidents Club & Super Starts require them to Sell a Simple to be eligible. These trips were extravagant with Celebrities such as Bruno Mars, Katie Perry, Pitbull, Blake Sheldon & Adam Levine to name a few.
We are taught and told on a daily basis to sell Simple's. The pressure can be overwhelming. ADP Executives have their fair share of pressure coming from Corporate Executives. Having their paycheck and next promotion rely upon Simple Sales, many resort to illegal and unethical behavior.
Almost all of ADP’s sales reps are unlicensed. Business Owners generally don’t know this and look at them for guidance, (Fiduciary). Sales Reps are only doing as taught, sell Simple's, no matter the situation, sell a Simple.
ADP’s Licensed Retirement staff better known as the “Simple Desk” are not acting in the best interest of the client either. After the unlicensed Sales Rep SELLS THE PLAN the “simple desk” is called to quickly implement the plan, never questioning the plan choice of the client.
To stay compliant and unbiased, ADP implemented 5 questions on a 1-5 scale 1 being the most important to the business owner. The calculator was designed to find out what they were looking for in a Retirement Plan. This was shortly around the time the DOL was passing the Law regarding Fiduciary responsibility and investment advice etc. (ERISA, BICE).
As mentioned in my other statement. Time after time the calculator response would come back as a SEP or 401k as the best choice for the client. This was almost always ignored and most of the time, the client wasn’t aware of what the calculator response said, or their other choices. It was “oh your perfect for a Simple IRA, you can make 8% to 12% Easy.”
After the Business Owner agrees to purchase a simple Ira the calculator response (simple, Sep, 401k) plus the business owner’s information is sent to the licensed Simple IRA’ desk, aka, ADP Broker Dealer, led by their President James Blake.
The Sales Rep calls into the Simple IRA Desk with the client as soon as they are done filling out the client information. Once a licensed Rep is on the phone the Rep is told to be quiet and not say anything in fear of them giving “investment advice.” The Licensed Simple IRA Team Member would never question the fact the Unbiased Simple IRA Calculator said something other than a Simple. They would just rush to implement the plan and walk them through the plan design.
In less than 20 mins that Business Owner’s plan is set up and implemented. Many clients complain about feeling pressured and were unsure about what they even agreed too. This is all due to the Sales Reps intense training.
The fee for a Simple IRA they are told is either a $275 upfront fee or $40 per month and for the Sales Rep carries a $1,200 commission for each Simple IRA they sell.
The cost of a SEP IRA is $50 for the entire year, maybe even two. Each SEP IRA carries a commission of only $600 to the Sales Rep. Plus, whatever extra incentive their Leaders wanted to add on top. The Simple is almost 10 times the cost of a SEP IRA and double the commission to the Sales Rep. Again, many times this is not in the best interest of the client but more in the best interest of the Sales Rep and ADP.
Like me, many other sales reps are often bribed with extra cash incentives, electronics and paid time off to sell Simple IRAs. It seems to be a nation-wide issue with ADP. ADP knows how to properly incentive their Employees but what most don’t know is how ADP publicly humiliates and ridicule’s the sales reps who don’t sell Simple's.
As seen here ADP Sales Executives like to Sprinkle a little fear into their Sales Reps to make them comply. Across the nation ADP Executives STEAL their Sales Reps photos from Facebook or other Social Media Accounts and then cut their head out of the photo and put it on a ridiculous and embarrassing Meme, creating what we like to call “Face in Hole” pics. The Southwest Florida Executives email the embarrassing often times discriminating picture to the whole region after the sales rep sells a Simple. IRA.
They say it’s for recognition and to stir up competition, but the truth is it’s demeaning towards the client. You can see a lot of the FIH Pics have some sort of derogatory comment such as “Knocked Them Out”, “Didn’t have a chance,” with many photos flaunting money and showing dollar signs laughing about how they just ripped off the client. Some are even racially motivated.
To make sure their reps stay complaint and keep producing the Sales Executives take the Sales Rep with the worst performance or who didn’t sell a Simple that week or month and make them get up in front of their whole region, which can be over 100 people and RAP in front of them.
They pick a Rap Song and then tell that Rep to get up and RAP and embarrass themselves for being terrible at their job. Some Reps act like they like it, and some cry.
We all know the number one biggest fear even over death, is Public Speaking. I’m sure Raping would surpass that on the “Biggest Fears List.” You can bet and almost guarantee that at that next meeting that Sales Rep who had to Rap won’t be holding the Mic this time. Take a look here with ADP’s CEO Carlos Rodriguez listing to an ADP Sales Rep Rap. Can't deny it Carlos, you know this behavior goes on. You even participate.... Great Leader ADP has.
I'm sure Carlos grew up a dork and now it's his time to fit in with the younger cooler sales reps. The same guys he used to idolize growing up, better yet, the guys who always used to get the girls. Anyone ever wonder why ADP hires nothing but Cheerleaders? You can't say they are all "SO Qualified." No offense but I used to do National Training's and I was shocked at the number of people who couldn't get what 3% of $50,000 was. P.S. (It said it right in front of them on their calculator). "Just saying."
As for me, on a number of different occasions I was Bribed by leaders to sell Simple IRA’s. I was offered Cash, Gift Cards and time off if I did what they asked.
I have even witnessed a Vice President of ADP bribe a client to buy a Simple IRA so his division could win a national contest for Simple IRA sales. I remember when my Boss and I were at a Boost Mobile store trying to close a deal with the owner and of course sell him a Simple IRA. The owner was a younger guy in his 30’s and he would have an objection for everything. This by far was the best sales training any Rep could have. My boss and I were shooting down Objection after Objection for nearly two hours.
The owner would just look at us and laugh. He told us he was getting a kick out of seeing us both take turns and then look at each other. My boss wanted to close that Simple IRA so bad the owner could see it. Hindsight it may have looked a little desperate but that is how ADP was, sell Simple's, sell Simple's.
The owner ended up asking what is it that he gets if he buys it, and he wasn’t meaning just the Simple. This is where I looked right at my boss with a shocked look and he looked right back at me with the same “Oh, ####! look.” The only words out of my bosses’ mouth were, “Ok, just do it.” That was my first experience with ADP Leaders actually bribing clients. The car ride back was full of emotion, a part felt like we won and the other part felt kind of dirty. Of course, I was told again that this didn’t happen. Welcome to ADP Retirement Simple IRA Sales.
From Sales Executives and Vice Presidents of Small Business Solutions all the way to Corporate Vice Presidents of Retirement Services have offered me bribes. Milina Corrochano, Bret DiGiacomo and Darren Glenn to name a few. ADP does what they need to do, to sell Simple IRA’s. NO matter what, “Roll Call Before Ethics.”
NOTE- Before someone sues me for the 3rd time remember I am already being sued for Defamation, Slander, Libel & Tortuous Interference. To sue someone for this, the statements they are saying must be untrue. I have supported my claims with clear cut evidence and don't worry I have a lot more..... I left the good stuff for the courts.
