French oil major TotalEnergies has paused its investments in Adani Group following allegations of bribery involving the Indian conglomerate's chairman, Gautam Adani.
The Adani Case has been on my mind over the past few weeks. As a #CIPS trained Supply Chain professional, I have to, as a matter of regulatory procedure, undertake periodic training on Ethical procurement in order to update myself not only on the Code of Conduct but also on the updates in regulation in matters Ethics, Bribery and Corruption, and in Sustainable practices.
The indictment of Adani in the US therefore presents a critical case study of the potential implications of the indictment globally, and at a corporate and personal level.
Gautam Adani, the chairman of the Adani Group, recently faced serious legal challenges after a U.S. indictment was issued, accusing him, along with his nephew Sagar Adani and several others, of alleged bribery related to power supply deals in India. The indictment, which was filed in a New York federal court, highlights allegations of both bribing Indian government officials and misleading investors, particularly in relation to lucrative solar energy contracts in India
The U.S. authorities claim that up to $265 million was offered in bribes to secure solar energy contracts from the Solar Energy Corporation of India (SECI), potentially leading to massive profits over a projected 20-year period. Specific allegations state that $228 million was directed to a prominent official in Andhra Pradesh. The U.S. Attorney's Office specifically accused the defendants of obstructing justice and raising funds from U.S. investors under false pretenses, a move that has initiated significant financial repercussions for the Adani Group.

What does such a global indictment mean, and what are its implications? Well, the Adani situation already points to a reputational risk for individuals and corporates. But beyond that, it also means that there is a risk of being arrested and charged in a court of law.
The biggest bribery annual report shows the largest bribery fine mentioned in the Skillcast article was $1 billion, paid by Glencore in 2022. The company faced charges for extensive bribery schemes involving oil contracts across several countries. It highlights the severe consequences of unethical practices, including reputational damage, financial loss, and legal repercussions.
