When it comes to the investment itself, there is no official minimum amount set by the U.S. Citizenship and Immigration Services (USCIS). The investment has to be “substantial” relative to the total cost of the business. The smaller the business, the larger the percentage of the total cost your investment should be. For example, if you are investing in a small café, you might need to invest a higher percentage than if you were investing in a large tech company.

And finally, your business cannot be just any venture. It needs to be a real, operating business with the potential to generate enough income to support you and your family in addition to contributing to the U.S. economy. In other words, it needs to be more than just a side hustle.

Change of Status vs. Consular Processing: Which Path Will You Take?

The E-2 visa interview process can vary depending on whether you are already in the U.S. or applying from abroad. If you are already in the country on a different nonimmigrant visa, like an H-1B , L-1 , or O-1, you might not even need to do an interview. You can simply file a new I-129 petition to change your status.

However, if you are outside the U.S. or do not have a nonimmigrant status, you will likely need to attend an interview at a U.S. Consulate or Embassy.

The E-2 Visa Interview

The purpose of the E-2 visa interview is to verify that you are who you say you are and that you meet all the qualifications. The key is to stay calm, be confident, and remember that if your case is solid, you have nothing to worry about.
