AB 434
Assembly Bill 434 was an amendment to Section 65585 of the Government Code, better known as the Planning and Zoning Law. The existing law requires that a public hearing be held or an application for an alteration of a zoning ordinance, conditional use permit, or equivalent development permit. AB 434 authorizes the Department of Housing and Community Development to notify the city, county, and/or the attorney general; if the local planning agency fails to comply with the provisions related to such hearings. ?
Now voted into law, AB 434 additionally authorizes the department to notify violations relating to hearings of accessory dwelling units, junior ADUs, and any denied permits for an unpermitted ADU constructed before January 1st, 2018.
