A $40,000 fine for Sending SMS Text Messages Without Proof of Consent

On July 11, 2023 the CRTC Enforcement Team announced a Notice of Violation, stating, "between 22 December 2020 and 14 January 2021, Sami Medouni sent or caused or permitted to be sent at least 31,925 phishing Commercial Electronic Messages (CEMs) without the consent of recipients, from fraudulently obtained telephone numbers."

This Notice of Violations hit 2 sweet spots for the CRTC Enforcement Team that Canadian business people should be aware of:

1) using SMS Text Messages without consent. Most Canadian businesses are aware that emails are considered a Commercial Electronic Message (CEM) under CASL, but the CRTC reminds us that SMS text messages are a CEM as well.

2) Phishing and online scams will be investigated.

Most of us can tolerate a bit of SPAM but none of us like being scammed or tricked into giving access.

Great to see these kinds of fines from the CRTC.
