189 years ago court action was taken in Cork Court by James Hodnett, against Major General Sir George Bingham, claiming wrongful arrest & detention.

189 years ago today a civil court action was commenced in the Courts in Cork Ireland by James Hodnett, a paper manufacturer of Riverstown, against Major General Sir George Bingham. Bingham, supported by the Lancers from Ballincollig, sought to prevent a meeting, opposing the payment of tithes, arranged for Whitechurch in July 1832 & occupied the site. Hodnett was arrested & taken to Carraig na bhFear.

Hodnett issued a summons against Bingham, claiming wrongful arrest & detention, and briefed Daniel O'Connell. O'Connell said his client was visiting Fr Begley & the round tower at Whitechurch. Nearby he met with Bingham, who became very excited, shouting to the Lancers: "There is the head of the rebels! Cut him down! Ride him down!" Fortunately, the Lancers ignored Bingham but directed Hodnett to ride to a house in Carraig na bhFear.

Both Fr Begley and Sir Anthony Perrier testified to having heard the order given by Bingham. The jury found against Bingham, but the justice frustrated the process by awarding the derisory sum of sixpence in damages, and a similar amount in costs.

A few days later the Corporation of Cork, in a sycophantic gesture, presented Bingham with an address.

The civil action taken by James Hodnett against General Bingham was initiated on 189 years ago today 21 November 1832.
