We can’t “Transform” something that doesn’t exist. America does not have a “child welfare system.” The system we have been trained to call "child welfare" is codified in federal law - the Child Abuse Prevention and Treatment Act (CAPTA, 1974) as "child protective services" (CPS) - is a family policing, family regulation, family destruction system. The 4 core components of CPS required by states to receive the extremely small amount of money under Title I of CAPTA ("budget dust" per Richard Wexler) are: surveillance ("mandated reporting"), investigation (looking for wrongdoing), court prosecution, and "treatment/services". "In the perfect world, ensuring a child’s safety shouldn’t have to be a struggle. But sometimes, certain critical measures are needed, and now, the steps to offer these measures are a little easier. The Administration for Children and Families (ACF) within the Department of Health and Human Services last week amended its?regulation?at 45 C.F.R. 1356 to expand access to legal representation for children who are eligible for title IV-E foster care, their parents, kinship caregivers, Indian custodians and tribes by allowing state and tribal child welfare agencies to use federal funds to provide legal representation." "Colby is no longer with us because we failed him." B.C.'s Representative for Children and Youth is calling on all levels of government to change regulations that would see more accountability for child welfare workers and hand over more agency to children, and where applicable, First Nations. Colby’s death is not an isolated incident. The report says in 2023 and 2024, the representative received 6,437 reports of children in government and foster care being harmed. Nearly 3,000 of those reports indicate a child faced critical injuries or death. The report highlights the need for a collective commitment to specific and larger transformative changes that will ensure the safety of our province's young people. It identified four major themes: the prevention of intimate partner and family violence; enhanced family support services; better inter-agency collaboration; and better support for those providing kinship care.

Data suggests that both nationally, and in Michigan, medically fragile children are more likely to experience abuse and neglect. In fact, even medically fragile children who have been placed in the foster care system continue to be at higher risk than peers to experience abuse and neglect. It is IMPERATIVE that child welfare leaders and staff, family court judges and attorneys, and medical providers INTEGRATE their work to protect these children when they become involved with the child welfare system. Policy and Advocacy Intern, Rachel Hamid, discusses one of the significant Children’s Agenda wins from the 2021 Oregon legislative session, SB 562, known as the Strengthen the Oregon Indian Child Welfare Act. The Indian Child Welfare Act (ICWA) is a federal law protecting the rights of Native children by allowing their parents, tribe, or tribal guardian to be involved in decisions regarding a child’s guardianship, parental rights, foster placement, and adoption. Data shows us Indigenous children are disproportionately sent to out-of home-placements. For example, 4% to 5% of Native American or Alaska Native children are in foster care, despite only making up about 1% of the total youth population in Oregon.
