I had meetings with two different clients today about fonts, and we weren't just chatting about Times New Roman or Comic Sans. Both clients are companies who care deeply about the look and feel of their brands, as many businesses do. They recognize that fonts play a crucial role in how their brands are perceived by the public. On the surface, fonts aren't protected under US copyright law. You might think that makes this a non-issue, but foundries can still control how they license out the software files associated with any given typeface. Just as there are nuances in the types of contracts tied to other types of software (like the different issues that pop up in contracts for cloud vs. on-prem), ensuring that your font licenses will meet your business needs is extremely fact-specific. Nirvana has reportedly resolved its trade mark dispute with Marc Jacobs over the use of a subtle variation of the iconic Nirvana smiley face logo: https://lnkd.in/gPQYKktR. One interesting note is that while Nirvana registered the copyright in the logo in the USA (NB there is no copyright registration system in Australia), Marc Jacobs argued that Nirvana in fact did not own copyright in its logo.?Marc Jacobs argued that the designer Robert Fisher has never assigned copyright.?This required Fisher to be joined to the lawsuit between Nirvana and Marc Jacobs. If you’re going to get a trade mark or other key logo designed for you, or other collateral that you want to use long-term in ways that you don’t even know yet, it’s advisable to obtain an assignment of copyright at that time.?You want to be able to control your own corporate or personal identity. For people who might not know, copyright is a form of intellectual property which grants the legal owner right over said for a period of years. These 'rights' comprises privileges such as copying, adapting, distributing, selling etc. For fashion, copyright comes in the forms stated above, however we will focus briefly on sketches. Fashion sketches are basically rough, unfinished drawing of clothing (take for instance the sketch of the infamous 'Jennifer Lopez Versace dress' ????) The sketch might not be as put together as the dress and only serves the purpose of explaining the idea from the designer's perspective. Sketches are protected under copyright law, by virtue of artistic expressions. However, the sketch must be original and unique. When is the Ballerina shoe design original enough for copyright protection as a work of applied art? Is it only composed of well-known basic shapes and standard elements that are not combined in an original way? ???????????? The Danish S?- OG HANDELSRETTEN KENDELSE (Maritime and Commercial Court) has ruled in favor of Ganni A/S, granting them a permanent injunction against Steve Madden Ltd. and Steve Madden Europe B.V. highlighting the following: ??“The court also emphasizes that Emmelie Karlstr?m [the designer] had a significant degree of freedom in designing and decorating the shoe, including with regard to the design and shaping of the individual elements, in particular the heel, sole, edge, toe, buckles, and rivets, and their specific composition and proportioning of the individual elements among each other, which is far from being exclusively technically determined […] ??”the Buckle Ballerina shoe uses well-known design elements from her previous GANNI designs, including in particular the heel, the sole, the buckles with the rivets, and the pointed toe, and the shoe is also inspired by the 1980s punk scene. Although the shoe's visual appearance has references to GANNI's design universe and other well-known design elements, the individual design elements are combined in such a way - which has not been seen before - that the shoe is an expression of the designer's own intellectual creation. In particular, the shoe's contrast between, on the one hand, the ballerina's fine, feminine shape with the pointed toe and the slingback strap, and on the other hand, the hardness of the outer sole and the heel's characteristic angularity together with the straps' punk-inspired buckles and rivets, reflects the designer's vision of "coolness". ??
