Today marks a significant yet bittersweet milestone in a challenging and heart-wrenching case we have been handling. We successfully filed an application under the Hague Convention for the return of two young children, aged 3 and 7, who were unfortunately abducted in Europe by their mother and not returned to their father. Child abduction is a profoundly sorrowful and complex issue, affecting not just the parents but, most importantly, the innocent children involved. The emotional toll and the sense of loss experienced by the left-behind parent are unimaginable. In this case, the father has faced an agonising wait, filled with uncertainty and longing for the return of his beloved children. While we celebrate the success of the application, our journey is far from over. We are now working closely with the South African Police and Interpol to locate the mother and the children. This requires sensitivity, diligence, and a deep commitment to the best interest of the children, ensuring their safe return to their rightful home. Child abduction cases are always shrouded in layers of emotion and complexity. They not only disrupt the lives of the children but also leave lasting emotional scars. We have hundreds of practical cases, in France over 20 years, where minors despite the proven sectarian danger are given by Family Courts to the sectarian parent (adept of #Sectarism) under the influence of a guru, pseudosciences, putting them at risk of lack of care and non-vaccination... Children of a sectarian divorce detained by a single sectarian parent who is, most of the time, consecrated by court’s decision in the exercise of an exclusive principal residence, offering a limited portion of visiting and accommodation rights often not even applied (with many non-aggravated presentations not prosecuted) in defiance of all the legal texts in force in France, in Europe, non-compliance with the Hague Convention and non-application of the CRC, thus fomenting remoteness, the total administrative disappearance of the non-sectarized parent. France is one of the few countries in Europe that does not want to judicially take into account the sectarian danger that weighs on the child of divorce. False allegations are often the legal defense brandished to remove the protective parent in the face of coercive persuasion that embraces the child to deliver him physically and psychically to the guru and intrasect predators. https://lnkd.in/eK7aaeyY No, nothing has changed in France since 2005 and even before despite this Country pretends to be the only one to fight cults.

The Supreme Court of Canada’s decision, Contino v. Leonelli-Contino, 2005 SCC 63 answers this question. In this case, the S.C.C. examined the application of section 9 of the Child Support Guidelines. Section 9 of the Federal Child Support Guidelines addresses the joint custody scenario: Where a spouse exercises a right of access to, or has physical custody of, a child for not less than 40 per cent of the time over the course of a year, the amount of the child support must be determined by taking into account the following: - the amounts set out in the applicable tables for each of the spouses; - the increased costs of shared custody arrangements; and - the conditions, means, needs and other circumstances of each spouse and of any child for whom support is sought.
